This letter responds to your November 6,1987 appeal of this Agency's denial of the document identified on Appendix B of our October 22, 1987 response to F01A-87-661.
In response to your appeal, the withheld material was acain reviewed.
On the basis of this review, I affirm the Agency's initial decision but on different grounds.
The document that has been withheld consists of the personal handwritten notes of an acency employee. These notes, which were prepared solely at the employee's discretion, were never circulated within the agency and could have been discarded at will, are not " agency" records within the meaning of the F0IA. Consequently, the Agency is under no obligation to make these notes available under the F0IA. See, Kalmin v. Department of the Navy, 605 F.Supp.1492 (D.D.C.1985) (uncirculated personal notes maintained at residence or in office desk drawer held to be personal property, not " agency records").
This letter represents final Agency action on your November 6, 1987 FOIA appeal. Judicial review of the denial of this document is available in Federal District Court in the district in which you reside, or have your principal place of business or in the District of Columbia.

The request includes any and all documentation on MRC's concern that they cannot make the licensing deadlines. (see attached article)                                                            .
