Dear Sir:

Docket No. 50-186 dated July 9,1974, was issued to MURR as Amendment No. 2 to Fac: lity-License No. R-103.

My understanding is that Title 10 of Regulation 50.22 states, "That in the case of a production or utilization f acility which is useful in the conduct of research and development activities of the types specified in Section 31 of the Act, such f acility is deemed to be for industrial or commercial purposes if the f acility is to be used so that more than 50 percent of the annual cost of owning and operating the f acility is devoted to the production of materials, products, or energy for sale or commercial distribution, or to the sale of services, other than research and development or education or training."

First, I would like to know if MURR is required to prove to the NRC that it is below the 50-percent requirement. If yes, I would like a copy of the report for 1978 and 1979 or the latest year. If no, does NRC mal 3 an inspection, and is this one of the requirements of a license inspection? If so, I would like your report reficcting results for

-1978 and 1979 or the last report is sued.

Second, I would like regulations or guidelines NRC uses to determine it is below the 50-percent requirement.

Third, I would like any infomtion which would be helpful to determine percent of costs devoted to the production of materials, products, or energy f or sale, etc.
