FPL Energy Point Beach, LLC letter to NRC, dated April 7,2009, License Amendment Request 261, Extended Power Uprate (ML091250564) Via Reference (I), NextEra made the following Regulatory Commitment: The high pressurizer pressure reactor trip delay time of less than or equal to I .O second will be verified by a time delay test prior to operation of that unit at EPU conditions. An engineering evaluation was performed. The evaluation determined response time testing of the high pressurizer pressure reactor trip instrument loops is not required because the trip will occur in less than 1.0 second, with a margin of 0.61 seconds. The evaluation provided a basis for the elimination of the response time testing requirement using WCAP 13632, Elimination of Pressure Sensor Response Time Testing Requirements, and EPRl NP-7243, Investigation of Response Time Requirements. Accordingly, NextEra is closing this Regulatory Commitment with no further action. If you have questions or require additional information, please contact Mr. James Costedio at 9201755-7427. FPL Energy Point Beach, LLC letter to NRC, dated April 7,2009, License Amendment Request 261, Extended Power Uprate (ML091250564)

Via Reference (I), NextEra made the following Regulatory Commitment:

The high pressurizer pressure reactor trip delay time of less than or equal to I.O second will be verified by a time delay test prior to operation of that unit at EPU conditions.
