Justification for andlor circumstances as to why extension Is necessary:

On February 18, 2010, during the Annual Commission Briefing on Research Programs, Performance, and Future Plans, RES briefed the Commission on the need for conducting a new comprehensive site Level 3 Pr~babilistic Risk Assessment (PRA). On March 19, 2010, the Commission issued staff requirements memorandum (SRM) M100218 (ML100780578), which directed the staff to: (1) continue internal coordination efforts and engage external stakeholders in formulating a plan and scope for future Level 3 PRAs, and (2) provide the Commission with various options for proceeding which include costs and perspectives on future uses. The SECY suspense date is February 7, 2011.

On September 27, 2010, the staff requested an extension of the due date for submitting the Commission paper that will provide both the results of the completed State-of-the-Art Reactor Consequence Analysis (SOARCA) pilot study and recommendations for if and how to proceed with additional analyses for other plant and containment configurations. The extension request was submitted to allow time to complete additional analyses, external outreach, and public review activities. On September 29, 2010. OEDO approved an extension to June 30, 2011 for submission to OEDO, and requested SECY reset the due date to July 7, 2011.

The latter request is still under consideration by SECY and the Commission.

On October 5, 2010, the staff submitted a Commissioners' Assistants (CA) note (ML102780604) to notify the Commission of its plans for completing the SOARCA study as well as its belief that the results and reconmendations for proceeding with both SOARCA and Level 3 PRA should be integrated in a single policy paper to the Commission. This CA note also informed the Commission of the staffs intent to submit an extension request to extend the due date for the Level 3 PRA Commission paper and provided justification for combining it with the SOARCA Commission paper.

An important first step is to align the schedules for providing the Commission with recommendations for proceeding with SOARCA and Level 3 PRA activities. This will facilitate informed Commission policy on whether and how to proceed with the next steps for either or both studies. The staff is therefore requesting an extension of the OEDO due date for submitting the Level 3 PRA Commission paper to June 30, 2011 and a reset of the SECY due date to July 7. 2011 to coincide with the SOARCA Commission paper. Based on the need to align with the new SOARCA schedule, the resetting of the SECY due date is justified by criteria #4 in OEDO Procedure - 0370 (requirements and/or schedules of other Federal agencies or stakeholders have changed, provided that staff has exhausted all means for expediting an NRC response). This schedule alignment will allow for the potential to provide the Commission with an integrated policy paper that addresses both SOARCA and Level 3 PRA.
