The NRC staff issued

NRC Bull etin 2005-02

on progress in

implementing sec

program enhancements. The

NRC s taff's ev aluat ion o f licen see re sponse s to th e bul letin indi cate th at all lice nsees are considering or

or Hostile

Actio n" (M ay 20 05, rev ised Nove mber 18 , 2005), to cl arify the v ariou s opti ons av aila ble to licensees

to implement the

se enhancements , and NEI al

so requested NRC

endorsement of

these optio ns in a let ter dat ed Nov ember 2 2, 200 5. SUMMARY OF ISSUE

The NEI guidance

clarifies i

ssues, enhance

s emergency acti

on level s, and provi

des implementation methods

in support of Bulletin 2005-02. The NRC staf

f finds that the

NEI guidan ce rema ins co nsiste nt wi th the inten t of the bull etin a nd is appro priate for li censee use. As suc h, the NRC s taff endor

ses thi s NEI gu idanc e docu ment with the following cl

arifications:

1. The NR C staff re

cogniz es the need for the U.S. De partmen t of Home land Securi ty (DHS) to be i

nvolve d in the rev

iew and endorsement of prop

osed enhance

ments to the

drill and e xerci se pro gram that impac t the d emonstr ation and e valu ation of offsite

respon se organ izat ion c apabi liti es in respo nse to a secu rity even t-base d scen ario. In coordination

with DH S, the NRC s

taff will ev

aluate changes

to the scenari

o scope or

extent of play for the proposed sec

urity event-based EP biennial exercise after NEI

submits forthcoming in

dustry guidel

ines for the dev

elopment of EP d

rill and exercise threat-based scen

arios. Lice

nsees are not

expected to

schedule se

curity-based

biennial exercises

until NRC endorses, in

coordinatio

n with D HS, forthcoming indu

stry guideli

nes and completes

revision s to regulation

and guidance , as deemed ap

plicable.2. Attachment 4 ("Ex

ample Tools for the

Developme nt of Onsite Protecti

ve Action s") to the

NEI guidance states in the discussion of

possible actions, that the phrase "tak

e cover" is

an action i

ntended to al

low the use of an immedi

ately av ailable structure to prov

ide person nel p rotecti on. The se stru ctures shoul d be i n desi gnated locat ions that ar e locat ed aw ay from potent ial t arget bu ildi ngs as d iscus sed i n NRC's Sa feguards Advi sory for O peratin g Power Rea

ctors (SA 05-02

). In add

ition, t he example

s of th e protec tive action deci

sion-making tools

also shoul

d provide site-specific

guidance for these

locations.

3. Attach ment 5 ("Integra tion a nd Dem onstra tion o f Emergenc

y Res ponse Secur ity Events") to N

EI guidance ex

pects that ov

Licensees u

sing the NEI gui

dance to chan

ge their emergency

plans shoul

d ensure that p

lan changes are coord

inated w ith offsite response

organization

s. Although the

NEI guidance

provides an acceptabl

e method for imple

menting enhancemen

ts, licensee

s may sele

ct other methods. If licens

ees adopt the

changes as w

ritten in Bu

lletin 20 05-02 and the

NEI guidance, the NRC staff believes that thos

e changes, on their own, would likely not pose a decrease in

effectiv eness and co uld b e perfor med und er 10 C FR 50.54(q) w ithou t prio r NRC approv al. Howeve r, licensees

have the

responsibil

ity to ens

ure that changes d

o not decrease

the effectiveness of the e

mergency plans

and that the

changed plans

continue to mee

t the standards of 10 C

FR 50.47(b) an

d the requirements

of Appendix

E to 10 CF

R Part 50. The

NRC staff recognizes

that other methods

for implementing the

enhancements a

lso may be

acceptable, b

ut note that li

censees shoul

d review these methods to

ensure they

do not decrease the e

ffectiveness of the emergenc

y plans. Without application to

and approv

al by the NRC, lice nsee may no

t implement prop

osed changes tha

t decrease the

effectiveness of the

approved e

mergency plans
