NRC-2018-000018 On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter dated June 12, 2018, in which you appealed the agency's decision related to your Freedom of Information Act (FOIA) request NRC-2018-000018, which sought the same search as FOIA 2016-0557

[All records classified "non-public" placed in ADAMS on April 13, 2016] but for May 1st, 2017 (NRC-2018-000018).

Specifically, you appealed the adequacy of search. Acting on your appeal, I have reviewed the records for this case and have determined that, as stated in our final response to you regarding NRC-2018-000018, the search for records in response to FOIA/PA 2016-0557 that were placed in ADAMS on May 1st, 2017 yielded responsive records in excess of 2,000 pages. Since you stated that you do not agree to pay any fees, and you were denied a fee waiver, you are entitled to 2 hours2.314815e-5 days <br />5.555556e-4 hours <br />3.306878e-6 weeks <br />7.61e-7 months <br /> search time free of charge as well as 100 pages free of charge as a non-excepted requester without incurring any fees. Because your request resulted in responsive records beyond the available free pages and hours, and you have not fashioned a request within this limit, I have denied your appeal. This is the final agency decision.

As set forth in the FOIA (5 U.S.C. 552(a)(4)(B)), you can seek judicial review of this decision in a district court of the United States in the district in which you reside or have your principal place of business, in the district where the agency's records are situated, or in the District of Columbia.

As part of the 2007 FOIA amendments, the Office of Government Information Services (OGIS) was created to offer mediation services to resolve disputes between FOIA requesters and Federal agencies as a nonexclusive alternative to litigation.
