November 27, 2013 ORDER (Denying Clearwater's Request for Judicial Notice)

On November 15, 2013, Hudson River Sloop Clearwater, Inc. (Clearwater) filed a request that the Board take judicial notice of certain facts contained in the judicial opinion in Brooklyn Ctr. for Indep. of the Disabled v. Bloomberg, 1:11 Civ 6690 (S.D.N.Y. Nov. 7, 2013), finding that New York City's evacuation plans violate the Americans with Disabilities Act.

1 The NRC Staff and Entergy have filed motions opposi ng Clearwater's request for judicial notice.

2 The Board finds that the facts detailed in Appendix A of Clearwater's request are outside the scope of this proceeding, as Brooklyn Ctr. for Independence of the Disabled dealt with emergency planning 3 and CW-EC-3A dealt with environmental justice issues.
