We have reviewed the final revisions to the Oregon regulations in (OAR) Chapter 333, Divisions 100, 102, 116, 118. and 125, received by our office on November 30, 2021. These regulations were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements of Regulation Amendment Tracking System Identification Numbers (RATS IDs) 2018-1 and 2018-2 as identified in the enclosed State Regulation Status (SRS)
Data Sheet. We discussed our review of the regulations with you on December 17, 2021.
As a result of our review, we have four comments required for compatibility, and one comment not required for compatibility that have been identified in the enclosure. Please note that we have limited our review to regulations required for compatibility and/or health and safety. We have determined that if these regulations are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.
We request that when you revise your regulations to address our comments, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made by Oregon in response to our comments, and provide a copy to Division of Material Safety, State, Tribal, and Rulemaking Programs, NMSS. The SRS Data Sheet summarizes our knowledge of the status of other Oregon regulations, as indicated. Please let us know if you note any inaccuracies or have any comments on the information contained in the SRS Data Sheet. After implantation but before the patient leaves the post-treatment recovery area: the treatment site, the number of sources implanted, the total source strength implanted, and the date; or.... Oregon needs to include the date in their equivalent regulation for permanent implant brachytherapy.
Oregon needs to make the change indicated above to meet the Compatibility Category H&S designation assigned to 10 CFR 35.40.

STATE SECTION NRC SECTION RATS ID CATEGORY SUBJECT and COMMENTS OAR 333-116-0660(3)(b) does not contain the portion of 35.290(c)(1)(ii) which states, [a]n authorized nuclear pharmacist who meets the requirements in § 35.55 or § 35.57 may provide the supervised work experience for paragraph (c)(1)(ii)(G) of this section. Oregon needs to add this statement with the equivalent state regulations.
Additionally, OAR 333-116-0660(4) does not contain an equivalent reference to 35.200 as stated in 35.290(c)(2). Oregon needs to add the equivalent reference to 35.200.
Oregon needs to make the change indicated above to meet the Compatibility Category B designation assigned to 10 CFR 35.290.
4  333-116-  35.394      2018-1  B        Training for the oral administration 0687                                  of sodium iodide I-131 requiring a written directive in quantities greater than 1.22 gigabecquerels (33 millicuries).
10 CFR 35.394(c)(3)(i) and (ii) describe a preceptor authorized user or a residency program director as having experience administering dosages specified in 35.390(b)(1)(ii)(G)(2). OAR 333-116-0687 incorrectly specifies OAR 333-116-0687(2)(b)(F)(ii) as the state equivalent for 35.390(b)(1)(ii)(G)(2),
The correct reference should be OAR 333-116-0680(2)(b)(F)(ii).
Oregon needs to correct the reference for 35.390(b)(1)(ii)(G)(2) as stated above to meet the Compatibility Category B designation for 35.394.
