Dear Ms. Barney:

This is in response to your request for relief from fees associated with your February 21, 1996, application for a specific license to export byproduct material to Vietnam.

Your application (NRC Form 7) was submitted with the associated application fee of $4,600.

Your subsequent February 23, 1996, letter asked for: 1) relief from the specific license requirement; 2) relief from the costs associated with the application; and 3) specific authority to use a general license.

The bases for your request are:

1) President Clinton on February 3, 1994, lifted the trade embargo against Vietnam; and 2) the NRC should have imediately implemented this policy by revising its regulations in 6110.28 of 10 CFR 110 by deleting Vietnam from NRC's embargoed list.

At the time of your application, the agency's requirement _ for a specific license for byproduct material exports to Vietnam was in accordance with Executive Branch policy.

At that time the Executive Branch was not prepared to recomend to the NRC that Vietnam be removed from the embargoed list.

The NRC received revised policy guidance from the Executive Branch and modified its regulations only after the agency had already issued the license that you had requested.

Consequently, the authority could not be granted under a general license and your request for relief from the specific license i

requirements could not be approved. The Office of International Programe had reviewed your application,'and after obtaining the U.S. Department of n ate's April 1, 1996 recommendation, issued specific License XB001291 on April 4, 1996.

Section 170.12(a) of Part 170 of the Commission's regulations, copy enclosed, provides that application fees will be charged irrespective of the Commission's disposition of the application or a withdrawal of the application.

Because a considerable amount of time was spent to review your application and issue the specific license, there is no basis to grant relief from payment of the $4,600 application fee required in 10 CFR 170.31, fee category 158.

Such a waiver of the fee is not authorized by law nor otherwise in the public interest since it would be inconsistent with the manner in which 10 CFR 170 is applied to other licensees. Accordingly, the fee is not refundable.

Attachment to NRC Form 7, APPLICATION FOR LICENSE TO EXPORT NUCLEAR MATERIAL AND EQUIPMENT Item 25:

The byproduct material referenced in this application is in the form of sealed sources used for the measurement of basis weight in the manufacture of paper products. Each source will be installed in a device registered with the USNRC as model TG-4, No. NR-109-D-121-B, and approved for distribution to specific or general licensees of the USNRC or an Agreement State. We operate under USNRC Material Licenses 34-00255-03 and 34-00255-06G.

This sensor is part of a large automated process control system, the balance of which has been approved for export to Vietnam by both the State Department and Commerce Department.

The ultimate consignees shown in items 10 and 12 are current firm orders. We anticipate further orders from other facilities in Vietnam in the future.
