On February 23,1998, staff of the U.S. Nuclear Regulatory Commission Uranium Recovery Branch held a public meeting with representatives of the uranium recovery industry at NRC headquarters in Rockville, Maryland. The purpose of this meeting was to discuss how the NRC staff had addressed comments from the public on the Draft Standard Review Plan for in Situ Leach Uranium Extraction (NUREG-1569). Enclosed is a summary of the meeting minutes, with its attached attendance list and presentation materials from the workshop.

n MINUTES FROM THE FEBRUARY 23,1998, PUBLIC MEETING ON THE STANDARD REVIEW PLAN FOR /N SITU LEACH URANIUM EXTRACTION (NUREG-1569)

On February 23,1998, staff of the Division of Waste Management and its contractor, the Center for Nuclear Waste Regulatory Analyses held a public meeting to discuss comments received on NUREG-1569, " Draft Standard Review Plan for in Situ Leach Uranium Extraction License Applications." The NUREG had been previously issued for public comment with the comment period ending on December 8,1998. A total of 210 comments from various organizations were received both before and after the closure date. Prior to the meeting, all comments received had been reviewed and addressed by the NRC staff. Thre purpose of the meeting was to: (1) discuss staff responses to the comments; (2) provide further clarification on how the NUREG was, developed; and (3) answer questions that the industry had on particular aspects of the staff positions taken in the NUREG. Attendees at the meeting included representatives of the National Mining Association, the Nuclear Energy Institute, and the licensed community. Overall, the meeting was successful in helping industry understand what the staff had done in preparing the draft document, and providing additional insight into the specific criteria contained in the NUREG. The staff plans to issue the final NUREG in late Spring /early Summer, and will begin using it in the review of applications for new licenses, renewals, and amendments.

As a result of the meeting, the NRC staff agreed to address severalissues raised at the meeting.

These issues are enclosed as attachment 1. Enclosed as attachment 2, is a list of all meeting attendees, and attachment 3 contains the rneeting handouts from the workshop.

b ATTACHMENT ONE COMMENTS TO BE ADDRESSED BY THE NRC STAFF

.AS A RESULT OF THE FEBRUARY 23,1998, PUBLIC MEETING ON THE STANDARD REVIEW PLAN FOR IN SITU LEACH URAN!UM EXTRACTION (NUREG-1569) 1.

The design attematives in the altematives section of the standard review plan should not be described at the maximum level, but are rnore appropriately described at a

=

reconnaissance level.

2.

The guidance for surface water impoundments should indicate that for most in situ leach facilities much of the guidance does not apply.

i 3.

The draft standard review plan should reference National Park Service Bulletin 38 for j

guidance on 36 CFR 800.

4.

The Environmental Justice Section should explain that for in situ leach facilities, siting is

]

not really a factor that you can evaluate in the context of environmentaljustice, but the j

spplication of technology can be.

The approach to identify spills that would exceed cleanup standards should be clarified or the requirement to report these types of spills should be reevaluated.

The requirement for a species assessment at a 50 mile radius is unnecessary and I

unreasonable, 7..

Recommended packer testing procedures should be improved so that there is a common technical basis for the procedures.

8.

Requirements to evaluate impoundment design should be consolidated into Section 4 of the draft standard review plan.

9.

The words "likely to" should not refer to the probability of an event occurring, but to the most probable impacts from an event.
