DEPARTMENT OF HOMELAND SECURITY OFFSITE DEFICIENCIES IDENTIFIED DURING THE JULY 21, 2009, FORT CALHOUN STATION EMERGENCY PREPAREDNESS EXERCISE

Dear Mr. Bannister:

Enclosed are copies of Federal Emergency Management Agencys (FEMA) Region VIIs letters to the States of Nebraska and Iowa, both dated August 4, 2009. These letters discuss exercise deficiencies identified during evaluation of the July 21, 2009, emergency preparedness exercise at the Ft. Calhoun Station. The Federal Emergency Management Agency defines a deficiency as an observed or identified inadequacy of organizational performance in an exercise that could cause a finding that offsite emergency preparedness is not adequate to provide reasonable assurance that appropriate measures can be taken in the event of a radiological emergency to protect the health and safety of the public living in the vicinity of a nuclear power plant. Specifically, the deficiencies were related to implementing Criterion 5a1, activities associated with primary alerting and notification of the public are completed in a timely manner following the initial decision by authorized offsite officials to notify the public of an emergency situation (10 CFR Part 50, Appendix E and NUREG-0654, E.1., 4., 5., 6., 7.). The specifics of the deficiencies for each of the participating states are described in the enclosed letters.

The purpose of this letter is to communicate FEMAs official notification of the deficiencies in accordance with the NRC-FEMA Memorandum of Understanding. No response to the Nuclear Regulatory Commission is required.

The NRC encourages Ft. Calhoun Station to work with the appropriate offsite governmental agencies to ensure a timely resolution of these issues. The NRC will continue to monitor the status of these issues. In accordance with the Memorandum of Understanding, the NRC and FEMA will assess the progress made toward resolution of these issues by approximately November 18, 2009, and will decide at that time if additional measures are necessary.

If the issues are not resolved by November 18, 2009, FEMA may withdraw the finding of reasonable assurance according to the requirements of 44 CFR 350.13(a). At that time the NRC would take appropriate action according to the requirements of 10 CFR 50.54(s)(2) and 50.54(s)(3).
