CONFIRMATORY ORDER TO FIRSTENERGY NUCLEAR OPERATING COMPANY   This is to inform the Commission that a Confirmatory Order (CO) will be issued on or about February 20, 2013, to FirstEnergy Nuclear Operating Company (FENOC, licensee), confirming FENOC's commitment to submit its license amendment request (LAR) by December 31, 2013. This LAR will transition the Beaver Valley Power Station (BVPS) Units 1 and 2, to the National Fire Protection Association (NFPA) Standard 805, "Performance-Based Standard for Fire Protection for Light Water Reactor Electric Generating Plants," in accordance with Section 50.48(c) to Title 10 of the Code of Federal Regulations. The staff reviewed this information, and finds that FENOC has provided adequate justification for the submittal delay. The CO constitutes the NRCs acceptance of the proposed December 31, 2013 submittal date, and extends enforcement discretion for certain fire protection noncompliances for BVPS Units 1 and 2 until December 31, 2013.
