UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 March 20, 2018 Gary Burke Confederated Tribes of the Umatilla Indian Reservation 46411 Timine Way Pendleton, OR 97801

Dear Chairman Burke:

This letter is to notify you that a new transportation route for irradiated reactor fuel and certain types of nuclear waste has been approved that crosses your Tribal reservation lands.

The Advance Notification to Native American Tribes of Transportation of Certain Types of Nuclear Waste (Advance Notification Rule) published on June 11, 2012 (77 FR 34194),

amended the U.S. Nuclear Regulatory Commission (NRC) regulations in Title 10 of the Code of Federal Regulations (10 CFR) Parts 71 and 73 to require licensees to provide participating Federally recognized Tribes advance notification of commercial irradiated reactor fuel shipments and nuclear waste shipments meeting the criteria of 10 CFR §71.97(b) which may be transported within or across Tribal reservations. In response to comments associated with the rulemaking, the NRC committed to contacting non-participating Tribes when a newly approved route crosses the Tribal reservation.

If you would like more information on the NRCs Advance Notification Rule or how to begin receiving notifications in advance of shipments, please contact Christian Einberg, at (301) 415-5422 or by e-mail at Christian.Einberg@nrc.gov.

Sincerely,

/RA/
