INDUSTRY WHITE PAPER - "ENHANCEMENTS TO EMERGENCYPREPAREDNESS PROGRAMS FOR HOSTILE ACTION" DATED NOVEMBER 15, 2005"

Dear Mr. Nelson:

We are in receipt of the subject White Paper and have reviewed it for adequacy. I would like tothank you and the members of the Nuclear Energy Institute (NEI) Emergency Preparedness Task Force for their effort in working through staff concerns while developing the White Paper.

Based upon a preliminary review by the staff, the NEI White Paper appears to describe appropriate enhancements to nuclear power plant emergency preparedness programs and provides adequate methods for implementation of elements of the Nuclear RegulatoryCommission (NRC) Bulletin 2005-02 "Emergency Preparedness And Response Actions forSecurity-Based Events," dated July 18, 2005. We view the White Paper as a positive contribution to the level of nuclear plant emergency preparedness.The Office of Nuclear Security and Incident Response (NSIR) intends to introduce the WhitePaper into the Regulatory Information Summary (RIS) process for endorsement. This process will include an important opportunity for State and local offsite response organizations, and thepublic to comment on the RIS endorsement. This being the case, the process will likely becompleted by mid 2006. We recognize the enhancements and methods contained in the WhitePaper and I would encourage licensees to use the review process in 10 CFR 50.54(q) to adopt those enhancements that can be so justified. Licensees that adopt these enhancementsshould perform the reviews with State and local governmental authorities in accordance with Appendix E of Part 50.The Emergency Preparedness Directorate (EPD) is dedicated to ensuring the adequacy ofnuclear plant preparedness and response. Bulletin 2005-02 was issued to ensure appropriate enhancements for response to security events were implemented. The staff has and willcontinue to work with the industry to achieve the Bulletin's objectives in the most efficient and effective manner.
