InthesecasestheNRCworksinpartnershipwiththeseStatesin fulfillingitsregulatoryresponsibilities.TheNRChasthe responsibilityforassuringtheadequacyandcompatibilityofthe State'sregulatoryprogramonaprogrammaticlevelbutdoesnot concurintheState'sspecificregulatoryactions.However,in conductingperiodicreviewsofAgreementStates'programsfor adequacyandcompatibility,NRCdoesexaminelicensingandother regulatoryactionstakenbytheState,includingenforcement actions,asindicatorsoftheprogram'sstatus.TheCommissionisreviewingitspracticesconcerningimplementationoftherequirementsintheAtomicEnergyActto ensurethattheAgreementStates'programsarecompatiblewith theNRC's.TheAgreementStateshaveexpressedincreasing concernoverNRC'sinterpretationofcompatibilityrequirements.
ConcernregardingNRC'sapproachtocompatibilitywassharply highlightedinthepublicresponsetotheCommission's"Below RegulatoryConcern"policystatement,whichwaspublishedinJuly 1990.Inlightofthisandotherconcerns,theNRCplaceda moratoriumontheimplementationofthepolicystatement;thatmoratoriumcontinuestobeineffect.AnoticeoftheCommission'srequestforpubliccommentwillbepublishedintheFederalRegisteronDecember23,1991.The Commissionisparticularlyinterestedincommentsthatrespondto anumberofquestionsprovidedinthisFederalRegisternotice.
