Report 0500026112016404, Dated December 27, 2016 Ladies and Gentlemen:
By the referenced
letter, the Nuclear Regulatory
Commission (NRC) notified Duke Energy Progress, LLC, of an Apparent Violation (AV) 0500026112016404-01, Security Safeguards
Control, associated
with a security incident at the H. B. Robinson Steam Electric Plant, Unit No. 2 (RNP). The letter states the AV is being considered
for an escalated
enforcement
action in accordance
with the NRC Enforcement
Policy. RNP accepts the apparent violation
and agrees with the conclusion
reached in the investigation
completed
by the NRC Office of Investigations
(01) concerning
activities
at RNP. The letter allows for a response to the AV in writing prior to the NRC making its final enforcement
decision.
The response to the violation
is presented
in the enclosure
to this letter. It is noted, the enclosure contains Security-Related
Information, withhold from public disclosure
under 10 CFR 2.390, in accordance
with 10 CFR 2.390(d)(1).

deficiencies
related to the security incident at RNP were entered in the station corrective
action program and a root cause evaluation
was performed.
Based on this evaluation, the enclosure
contains the response details which includes;
(1) restatement
of the apparent violation, (2) the reason for the apparent violation, (3) the date when full compliance
was restored, and (4) the prompt and comprehensive
corrective
actions. Duke Energy acknowledges
the significance
of the issue and the need for lasting and effective
corrective
actions. We further acknowledge
and align with the significance
of the issue previously
discussed
with the NRC and members of Duke Energy staff. Duke Energy demands employees
and contractors
act with integrity
and communicate
with candor. Any careless disregard
for requirements
or deliberate
violation
of requirements
are not to be tolerated. Duke Energy acknowledges
the willful aspects of this issue and understands
that the regulatory
program is based on licensee employees
acting with integrity
and further acknowledges
the need for lasting and effective
corrective
actions. There are no regulatory
commitments
associated
