50-330 OL RESPONSE IN OPPOSITION TO MOTION TO QUASH SUBPOENAS Consumers Power Company (" Consumers Power"), by its attorneys, submits its Response in Opposition to the Motion to Quash Subpoenas of Louis Clark, Thomas Devine, -

Billie Pirner Garde and Lucy Hallberg.

The deponents' motion is premised upon the contention that Consumers Power is seeking to expose the identity-of the anonymous " whistle- _

blowers" in order to deter other potential whistleblowers.

Their position is, as the record makes manifestly clear, false.~sj The motion should, therefore,' be denied.

In the alter.7ative, however, an appropriate protective order should be entered.

As movants' factual basis is completeiy inac-

curate, Consumers Power did not address the legal arguments set forth in the motion.

Moreover, the entry of a pro-tective order would also obviate the need to reach the issues raised by the movants.

Should, however, the Board deem it necessary to consider these issues Consumers would e

request the opportunity to supplement its response.

In its Application for Deposition Subpoenas, Consumers Power stated, at paragraph 5:

Applicant is not attempting to discover the iden-tities of the GAP at;iants.

The "Schedulelof Documents Requested" attached to the deposition I

subpoenas requests copies of the GAP affidavits l

with the identities of affiants and identifying information regarding them deleted.

Moreover, Applicant will not ask for the names of the af-fiants during the requested depositions.

There is no need, therefore, 'to issue a protective order protecting against disclosure of the GAP affiants' l

I identities.

As noted above, in the Schedule of Documents Requested, at paragraph 1, Consumers Power included the provision that "the affiant's name and any information which would disclose the affiant's identity" should be deleted,

from the requested statements.and affidavits.

3.

By letter of April 6, 1983,. a copy of which is attached, Mr. David M. Stahl,,one of the attorneys for Consumers Power, communicated with one of the attorneys at GAP, seeking to reach an agreement concerning disclosure of the affiant's identity in order to resolve these matters be-fore the depositions.

Mr. Stahl repeated, however, that absent such an agreement, Consumers Power would consider

itself bound by the self-imposed limitation.cohtained in the application.

No response of any kind was ever received from GAP to Mr. Stahl's re, quest.

It is clear that, contrary to GAP',s spurious

t assertions, the scope of discovery has been limited and the affiants' anonymity will be preserved.

The motion to quash

'should, accordingly, be dismissed and the deponents com-pelled to appear.

6.

In the alternative, Consumers Power would suggest entry of a protective order providing the following:

a.

that a lettering system be adopted for each of the Affiant's requesting anonymity and utilized during the depositions and document productions; b.

that should the identity-of or identifying information concerning any Affiant, through error or inadvertence, become known during the depositions or document productions, the parties agree not to disclose such infor-mation; that the identity of or identifying infor-c.

mation concerning any affiant inadvertently disclosed during a deposition shall be de-leted from the transcript; d.

that any documents',' and all cop'ies, inad-vertently produced revealing the identity of or any identifying infjormation concerning an affiant shall,have that name or information deleted; and that the term " identifying information" shall e.

mean employer's name, affiant's job title and similar information and shall be construed so as to protect the-identity of the affiant but

consistent with applicant's need for in-

-formation concerning the substance and basis for affiants' allegations.

Attorneys for Consumers Power again attempted to resolve this matter informally but were unable to elicit a response from movants' attorney, despite placing several

telephone calls.

WHEREFORE, Consumers Power Company requests entry of an order dismissing the Motion to Qtiash and compelling the deponents to appear or, in the alternative, entry of such protective order as the Board may deem just and proper.

Garde and Lucy Halberg (the " GAP Depo-sitions") pursuant to the subpoenas issued by the Board in its Order dated July 8, 1982.
