In accordance with your application dated August 27, 1999, and revision dated September 8, 1999, and pursuant to Part 70 to Title 10 of the Code of Federal Regulations, Materials License SNM-696 is hereby amended to remove references to "Torrey Pines South" land area from your NRC SNM license and to release this area to unrestricted use.
In your letters, you stated that the buildings and lands on Torrey Pines South were never used for activities involving NRC-licensed radioactive materials, but had been included in the overall site license. Our review has determined that there is reasonable assurance that the release of Torrey Pines South for unrestricted use will not adversely affect public health and safety or the environment.
Accordingly, Safety License Condition S-1 has been revised to include the dates of August 27 and September 8, 1999, (Torrey Pines South).
If, in the future, you desire to use licensed materials and conduct licensed activities in these facilities you must request and obtain an amendment to your license.
All other conditions of this license shall remain the same.
Enclosed are copies of the Materials License SNM-696 and the Safety Evaluation Report, which includes the Categorical Exclusion determination.
