May 02, 2006 EN-06-018 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: South Carolina Electric & Gas Company (EA-06-046)

V. C. Summer Nuclear Station Docket No. 05000395

Subject:

ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation associated with a White significance determination process finding will be issued on or about May 5, 2006, to South Carolina Electric

& Gas Company as a result of inspections at the V. C. Summer Plant. This White finding, an issue of low to moderate safety significance which may require additional NRC inspection, involved shipment of radioactive material which contained a package with radiation levels on the external surfaces that exceeded applicable regulatory requirements.

A Notice of Violation is included based on a violation of 10 CFR 71.5 and 49 CFR 173.441 because the licensee failed to properly design and prepare for shipment a package of radioactive material that was transported from the licensees facility to an offsite waste processing vendor. Specifically, a package was shipped by V. C. Summer on May 26, 2005, and arrived at a waste processing vendor facility in Oak Ridge, Tennessee, on May 27, 2005, with contact radiation levels of 600 millirem per hour on the side external surface of the package in one specific location that was approximately 10 feet from the ground. This exceeded the regulatory limit of 200 millirem per hour at any point on the external surface of the package per 10 CFR 71.5 and 49 CFR 173.441.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

Mailing of Final Significance Determination May 5, 2006 Telephone Notification of Licensee May 5, 2006 The States of South Carolina and Tennessee will be notified.
