On October 10, 2016, you sent the U.S. Nuclear Regulatory Commission (NRC) a Freedom of Information Act (FOIA) request (Case Number FOIA 2017-0034) for several historic Office of the Secretary (SECY) papers and, if necessary, you requested a declassification review for the historic records. On April 6, 2017, the NRC informed you that your request for SECY 79-263, Classified Paper, dated April 16, 1979, had been changed to a request for a Mandatory Declassification Review under Section 3.5 of Executive Order (E.O.) 13526, Classified National Security Information (Agencywide Documents Access and Management System Accession No. ML17089A203).
The NRC conducted a line-by-line review of the requested document and consulted with other agencies that potentially had equity in the document. Following these activities, the agency has declassified and authorized the release of the document (Enclosure).
In accordance with E.O. 13526 and Title 32 of the Code of Federal Regulations Part 2001, Classified National Security Information, if you feel that this assessment and review is incorrect, you have the right to an administrative appeal, which must be filed within 60 days of receipt of this letter. All administrative appeals shall be made to:
