September 10, 2015 EN 15-026 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Exelon Generation Company, LLC EA-15-115 Dresden Nuclear Power Station, Unit 2 Docket No.: 50-237

Subject:

ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation (NOV) associated with a White Significance Determination Process finding will be issued on or about September 16, 2015, to Exelon Generation Company, LLC (licensee) as a result of an inspection at Dresden Nuclear Power Station, Unit 2 (Dresden 2). The White finding, an issue of low to moderate safety significance, will result in additional NRC inspection and potentially other NRC action.

The White finding involved the licensee's failure to establish measures for the selection, and review for suitability of application of materials, parts, equipment, and processes that are essential to the safety-related functions of the structures, systems, and components involving

the Dresden 2 Automatic Depressurization System (ADS). Specifically, from December 1, 2009, to February 7, 2015, the licensee failed to establish measures to ensure that the application of the ADS electromatic relief valve (ERV) actuators remained suitable for operation. This resulted in a failure of the 2C ERV, and an indeterminate period of inoperability and unavailability greater than allowed by the technical specifications. The 2C ERV inoperability was identified after the failure of the valve during its first operational test in a mid-cycle outage.

Additionally, because the licensee was not aware of the valve's inoperability between 2013 and 2015, the required technical specification actions were not followed.

A NOV is included based on the licensee's failure to establish measures for the review for suitability of application of parts that are essential to the safety-related functions of systems and components in accordance with Title 10 of the Code of Federal Regulations (10 CFR) part 50, Appendix B, Criterion III, "Design Control".

On August 13, 2015, the licensee indicated that they did not contest the NRC characterization of the violation or the risk significance of this finding. Further, the licensee declined to discuss this issue in a Regulatory Conference or to provide additional information in a written response. The licensee has not yet been informed of the specific nature of the enforcement action. The schedule of issuance and notification is: Mailing of Final Significance Determination September 16, 2015 Telephone Notification of Licensee September 16, 2015

The State of Illinois will be notified.
