2.tEach.partyagrees,inperforminganalysesfortheother,toprovideahighstandardofprofessionalservice,provided,however,thatneitherpartyshallhaveanyobligationorliabilityfordamages,including,butnotlimitedto,consequentialdamages,arisingoutoforinconnectionwiththeother'suseof,orrelianceon,theresultsofsuchanalyses.3.Zf,atanytime,eitherpartyanticipatesthetemporaryunavailabilityofitslaboratoryfacilitiesorpersonnelforanyreasonorsuchfacilitiesorpersonnelarerenderedunavailableduetoanaccidentoractofGod,suchpartyshallpromptlynotifytheotherpartyoftheanticipatedoractualunavailabilityofsuchfacilitiesorpersonnelandtheexpecteddurationthereofinorderthattheotherpartymaymakeothersuitabletemporaryarrangementsforanalyses,theexpensesofwhicharrangementsshallbebornebythepartymakingthearrangements.Neitherpartyshallhaveanyobligationorliabilityofanykind,arisingoutoforinconnectionwith,theunavailabilityofitsfacilitiesorpersonnelasprovidedinthisSection3.4.Thisagreementshallbeeffectiveonthedatehereofandshallcontinueuntilterminatedashereinaftersetforth.Eitherpartyhereto.mayterminatethisagreementatanytimehereafteruponsixty(60)dayswrittennoticeofsuchtermination'totheotherparty.INWITNESSWHEREOF,thepartiesheretohavehereuntosettheirhandsthedayandyearfirstabovewritten.APPROVEDASFOFORhlINDIANA6MICHIGANELECTRICCOMPANYCONSUMRSPOWERCOMPANYLEGAt.DE('ARTh'lFNlByR.S.Hunter-VicePresidentCONSUMERSPOWERCOMPANY
