Contention 15 asserts that Entergy's LRA fails to satisfy 10 C.F.R. § 54. 31. Contention 15 asserts that the NRC regulations provides that in the event the NRC approves the LRA, then the old license is retired, and a new superseding license will be issued, as a matter of law § 54.31. Therefore all citing criteria for a new license must be fully considered including population density, emergency plans and seismology.

At the Nuclear Regulatory Commission's public meeting in Cortland Manor on June 18, 2008 five NRC senior officials discussed progress of the Indian Point LRA and the current status of Indian Point owner's request for 20 additional years of operation. Present were Sam Collins, D. Roberts, R Conte, Rani Franovich, Chief License Renewal Branch, NRR, Dr. Bo Pham and others.
