AFFIDAVIT Kim Arthur Siegfried.first being duly sworn, deposes and saysl:

I have previously appeared in this case as counsel for intervenor Citizens for Employmant and Energy and acted in that capacity until 1979 when I was forced for personal reas !

ons to withdraw as counsel for CEE.

That at the request of myself and CEE, Mr. David f

Howell entered an Appearance and substitution of counsel which was approved by the Licensing Board.

That although I resigned as counsel for CEE, I remained ;

, a member of CEE and attempted to assist Mr. Howell in his repre '

! aentation of CEE in this proceeding. On several occasions, due !

to conflicts in scheduling. I represented CEE in matters before the Licensi'ng Board until such time as Mr. Howell could appear.

That an appearance on behalf of CEE was never formally ertered by myself, and although this is not entirely clear on I

the record, the representation of CEE was as a member of the j

organization, not as "co-counsel".

5.

That most, but not all, of CEE's contacts with Mr.

Howell were through myself and during those contacts I had au-thority to act on behalf of CEE.

6.

Although I do not recall a speciff c conversation with Mr. Howell concerning the filing of proposed findings of fact, Mr. Howell was given full authority by myself and CEE to make dacisions he felt appropriate with regard to his legal repre-sentation of the organization in th'is proceeding.
