I. SECY-86-109/109A - Perry Appeal Board Decision to Hold an Exploratory Hearing on Safety Significance of Issues Raised in Intervenor's Motion to Reopen The Commission, by a 4-1 vote, approved an order addressing a decision of the Atomic Safety and Licensing Appeal Board to hold -
THURSDAY, APRIL 17, 1986, COM-MISSIONERS' CONFERENCE ROOM, D.C. OFFICE (OPEN TO PUBLIC ATTENDANCE)
an exploratory hearing to aid it in its determination of whether to reopen the Perry hearing on issues related to the facility's seismic design. The order vacates the Appeal Board's orders setting up the exploratory hearings, denies the motion to reopen and directs the NRC staff to be prepared to discuss the matters raised by the Board in its presentation before the Commission on the full power license. Commissioner Asselstine disapproved and provided separate views. Chairman Palladino also provided additional views.
