In accordance with 1 CFR Part 51, we request that you approve the incorporation by reference of the material listed below into Title 10 of the Code of Federal Regulations. We have uploaded a copy of each item to be incorporated by reference and a draft copy of the final rule entitled Approval of American Society of Mechanical Engineers Code Cases (RIN 3150-AJ94; NRC-2017-0025) to the Office of the Federal Registers FTP web portal on December 21, 2021.

The following materials will be referenced in 10 CFR 50.55a(a)(3), as follows:

1. NRC Regulatory Guide 1.84, Revision 39, December 2021, Design, Fabrication, and Materials Code Case Acceptability, ASME Section III. This regulatory guide is referenced in 10 CR 50.55a(a)(3)(i).

2. NRC Regulatory Guide 1.147, Revision 20, December 2021, Inservice Inspection Code Case Acceptability, ASME Section XI, Division 1. This regulatory guide is referenced in 10 CFR 50.55a(a)(3)(ii).

3. NRC Regulatory Guide 1.192, Revision 4, December 2021, Operation and Maintenance Code Case Acceptability, ASME OM Code. This regulatory guide is referenced in 10 CFR 50.55a(a)(3)(iii).

4. NUREG-2228, Weld Residual Stress Finite Element Analysis Validation: Part II Proposed Validation Procedure, July 2020. This NUREG is referenced in 10 CFR 50.55a(a)(3)(iv).
