Dear Jason Jennings Salem Nuclear Power Plant

The purpose of this email is to remind United States (U.S.) Nuclear Regulatory Commission (NRC) licensees and U.S. manufacturers about the upcoming deadline for the completion of Additional Protocol (AP) information that is required from certain licensees by treaty obligations between the U.S. and the International Atomic Energy Agency (IAEA). In order to meet our IAEA treaty obligations pursuant to the AP, the U.S. NRC is required to collect information on nuclear fuel cycle-related activities in the U.S. through the timely submission of AP forms.

After discussions with the IAEA, the NRC confirms that this would be the last annual report from your site. Site declarations and updates have to be submitted by the U.S. under Article 2.a.(iii) of the AP only for facilities and parts thereof selected by the IAEA for the application of safeguards under the U.S. - IAEA Voluntary Offer Agreement (VOA). Since your site has been deselected by the IAEA for the application of safeguards under the VOA, that should be also reflected in the subsequent AP declaration under Article 2.a.(iii) of the AP and no further update under the AP would need to be provided after this years final report. In short, please submit your final AP annual declaration. Please note that the IAEA may still request access to any U.S. facility listed in the VOA Eligible Facilities List (EFL) as described in Articles 4 through 6 of the AP.

REMINDER - FINAL REPORT - Completion of Required Additional Protocol (AP) Information in accordance with the U.S. - IAEA Treaty Obligations

The NRC underscores the importance of submitting the AP forms from your facility in accordance with Title 10 of the Code of Federal Regulations (10 CFR) 75.11(c) by the deadline of January 31, 2024. These forms shall be submitted to the U.S. Department of Commerces (DOC) Bureau of Industry and Security (BIS), which serves as the central AP forms repository for the federal government. All AP forms and handbooks can be found at www.ap.gov.

This link provides, among other things, the types of information that are reportable and information regarding how to submit the applicable AP forms to BIS. Failure of a licensee to submit the required forms by the specified deadlines (as noted above) may be dispositioned by the NRC as a noncompliance in accordance with the NRC Enforcement Policy, Agencywide Documents Access and Management System Accession (ADAMS) No. ML22336A179.

The DOC/NRC AP forms are approved under Office of Management and Budget (OMB) control number 0694-0135. The NRC may not conduct or sponsor, and a person is not required to respond to, a collection of information unless the document requesting or requiring the collection displays a currently valid OMB control number.
