Background and Status
* In early 1980s NRC added new reporting requirements in 10 CFR 50.72(b) for licensees to immediately notify NRC of potentially significant nonemergency events at nuclear power plants
* In 2018 NEI submitted petition for rulemaking requesting removal of nonemergency reporting requirements
* In 2021 Commission directed staff to pursue rulemaking
  - Do not shift responsibility for gathering, verifying, and communicating information on these events from licensees to resident inspectors
  - Discontinue rulemaking if not cost-justified or if changes would unacceptably degrade NRCs situational awareness.
* NRC is developing a regulatory basis for the rulemaking 5

  - Is it likely that elimination or modification of the reporting requirement would compromise plant or public safety?
* Specific Risks
  - What risks are associated with eliminating or modifying the reporting requirement?
  - Would eliminating or modifying the reporting requirement unacceptably degrade NRCs situational awareness or ability to provide effective oversight?
* NRC Actions
  - What actions are taken based on the reporting requirement?

  - Does the reporting requirement initiate external stakeholder action?
  - What are the consequences to of elimination or modification the reporting requirement?

  - Are other forms of communication available to receive this information (that do not burden resident inspectors)? What is the timeliness of these other forms?
  - What technology can be used to improve the flow of information for this requirement?
