This letter notifies you that the two White findings documented in the Nuclear Regulatory Commission (NRC) Inspection Report 05200025/2021011 (Agency Document and Management System (ADAMS) Accession No.ML21312A412) will remain open and that the performance at Vogtle Unit 3 will remain in the Regulatory Response Column of the Construction Action Matrix (CAM) because the supplemental inspection has not been conducted. These findings were identified during a special inspection conducted from June 21 to July 2, 2021 (Inspection Report No. 05200025/2021010 and 05200026/2021010, ADAMS Accession No. ML21236A057). As of January 1, 2022, the findings have been open for more than two quarters.
On November 17, 2021, the NRC issued the final significance determination and assessment follow-up letter for the two White findings in inspection report 05200025/2021011. In this letter, the NRC notified you that, in accordance with IMC 2505, Periodic Assessment of Construction Inspection Program Results, the performance at Vogtle Unit 3 was in the Regulatory Response Column of the Construction Action Matrix beginning in the third quarter of 2021. This letter also notified you that the NRC plans to conduct a supplemental inspection in accordance with Inspection Procedure (IP) 90001, Construction Regulatory Response Column Inspections.
This IP is conducted to verify that the root and contributing causes for the performance issues are understood, the extent of condition and extent of cause are identified, and the corrective actions are sufficient to address the root and contributing causes and to preclude repetition.
Per conversation with your staff on January 10, the NRC plans to conduct the supplemental inspection in the first calendar quarter of 2022. Should anything change regarding scheduling the supplemental inspection, we request that you notify us. In accordance with IMC 2505, the two White findings will not be closed until a supplemental inspection has been successfully completed. The CAM column will not be changed until the issuance of the associated inspection report (or other agency action), and an assessment follow-up letter noting the change in column. However, the findings will still be considered in the CAM for the remainder of the quarter. This letter supplements, but does not supersede, the annual assessment letter issued on March 3, 2021, (ADAMS Accession No. ML21061A216).

To the extent possible, your response should not include any personal privacy, proprietary, or safeguards information so that it can be made available to the public without redaction.
