COMMENTS ON CALIFORNIA IMPEP RESPONSE LETTER DATED DECEMBER 24,1997 Recommendation # 3 With rgard to the QM-Rule, the staff is revising 10 CFR Part 35 in its entirety. This effort includes input from State representatives and numerous opportunities for input from members of other interested groups and the public. A major reason for this revision is to address concems expressed about the QM Rule. This effort is expected to be completed by June 1999.
Datahnformation supporting the proposed revision of Pari 35 will be shared with the States and the public in an open atmosphere.
While we continue to encourage Agreement States to adopt a compatible QM-Rule, we will not address the QM-Rule under the IMPEP indicator for regulations until the Part 35 revision becomes effective.
s Recommendation # 14 We appreciate your recommendation that NRC adopt the same or similar checklist to evaluate devices used under a general license. We will share this checklist with the appropriate staff.

COMMENTS ON CALIFORNIA IMPEP RESPONSE LETTER DATED DECEMBER 24,1997 Recommendation # 3 With rgard to the QM-Rule, the staff is revising 10 CFR Part 35 in its entirety. This effort includes input from State representatives and numerous opportunities for input from members of other interested groups and the public. A major reason for this revision is to address concems expressed about the QM Rule. This effort is expected to be completed by June 1999.

Datahnformation supporting the proposed revision of Pari 35 will be shared with the States and the public in an open atmosphere.

While we continue to encourage Agreement States to adopt a compatible QM-Rule, we will not address the QM-Rule under the IMPEP indicator for regulations until the Part 35 revision becomes effective.

s Recommendation # 14 We appreciate your recommendation that NRC adopt the same or similar checklist to evaluate devices used under a general license. We will share this checklist with the appropriate staff.
