Dear Mr. Smith:

I This letter is in response to your application dated July 2,1998, requesting registration of Berthold Systems' Photon Gauges, your letter dated July 29,1998, providing additional information in support of the application, and the August 12,1998, meeting between you, your staff, and John Lubinski of my staff. We have evaulated the additionalinformation provided in your July 29,1998, letter and found that additional information is needed to continue our evaluaiton. Therefore, as discussed during the August 12,1998, meet'rg,  : we request that Berthold Systems provide the following information: l

1. Please verify that Berthold Systems understands that the sources used in the devices are not exempt from licensing. Specifically the devices, if the application is approved, will be considered as meeting the requirements of 10 CFR 32.51 and will be )

authorized for distribution to 10 CFR 31.5 general licensees. The sources, devices, and users are not exempt from licensing requirements. In addition, please commit that for all information provided to general licensees and additional information provided in support of your application, the product will not be referred to as exempt source devices nor indicate that the device will contain exempt sources.

2. Please verify that Berthold Systems understands that the devices will be restricted to normal conditions of use that are supported by the prototype testing information i provided with the July 29,1998, letter. Specifically, the registration certificate will restrict normal use to the following conditions:

Temperature: -25 to 50*C Unikely to be subjected to thermal shock Humidity: 0 to 100%

impact: Cannot be mounted at heights exceeding 30 feet Extemal Pressure: 3.6 psi to 1 atmosphere Vibration: low - simple harmonic motion having a maximum amplitude of 0.03 inches and maximum frequency of 50 Hz.

Corrosion: slight - i.e., low concentrations of corrosive fumes / chemicals and no exposure to direct outdoor environments.

Fire and Explosion: environments where fire and explosion are unlikely.

3. Please provide specific information, including detailed drawings, on how the sources and source holders will be mounted into each device. The drawings need to include complete dimensions of the fabricated area that will incorporate the epoxy and dimensions and method of attachment for the source holders (i.e., for the Model 301 series).

4. Please provide the following information for each of the following drawings submitted with your July 29,1998, letter:

R-NW201 The minimum thickness of parts 2,4, and 6.

' The tolerance for the diameter of part 4 (currently the dimension is 5").

The diameter of the fasteners - parts 1 and 7.

R-NW301 The range of dimensions for the length on the source housing.

The method of attachment between parts 3 and 4.

- The minimum wall thickness for part 3.

R-NW401 The minimum length and diameter of the source housing.

5. Your application indicates that the mounting mechanism for the source housings will be provided by Berthold Systems. Please provide specific information (structure and dimensions) on the designs of mounting mechanisms. You may include minimum dimensions or ranges for the mounting mechanisms. Please demonstrate that the mounting designs will withstand the normal conditions of use.

6. Please provide the material of construction for the teth?r that will be used to attach the labeling to the devices. The materials of construction must be able to withstand the likely conditions of use (e.g., stainless steel rope).

7. Page 2 of your July 29,1998, letter indicates the number of sources incorporated in each device that was tested. Please verify that the activity of each source was 10 pCi (370 kBq).

8. Please verify that radiation measurements were taken before and after each test and that the radiation levels were not higher after testing.

9. -.Your application indicates that users will install the devices. Therefore, please indicate the limitations on the installation of the devices (e.g., the smallest or largest pipe diameter to which a device will be installed) which will ensure that doses on contact with any accessible surface of the installation will not exceed 0.5 mrem /hr (5 pSv/hr).

10. Please commit that the dose rates at the surface of each source housing will not exceed 0.5 mrem /hr (5 pSv/hr), except at the surface of the beam port, which will not exceed 100 mrem /hr (1 mSv/hr). For the Model NW-301 series, please verify that the dose rate in the beam, along the axis of any individual beam port, decreases in

accordance with the increase-square rule for gamma radiation.

11. Attachment 6 of your July 29,1998, letter includes the procedures for shipping source housings. Please commit that all radiation dose level meters used when following this procedure will consist of a G-M tube with a minimum 1 inch diameter.

Please provide the requested information within thirty (30) days. If we do not receive the requested information within thirty (30) days of the date of this letter, we will consider your application as having been abandoned by you. This is without prejudice to the resubmission of a complete application.
