Dear Ms. Murphy:

This is in final response to your letter dated April 10, 1986, in which you requested, pursuant to the Freedom of Information Act (F0IA), records relating to Information Notice 86-05 and four other categories of records relating to main steam safety valves.

The records identified on enclosed Appendix G are the remaining records responsive to your request. The entire record identified at number two and paragraph four of the record identified at number one are being withheld pursuant to Exemption (5) of the F0IA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations. The remaining portions of the record identified at number one do not fall within the scope of your request.

Information withheld pursuant to Exemption (5) in paragraph four of the record identified at number one consists of the preliminary advice, opinions, and recommendations of a member of the staff. Release of this type of information would tend to inhibit the frank and candid exchange of information in future deliberations and would not be in the public interest. Information withheld pursuant to Exemption (5) in the record identified at number two is a draft document which contains the predecisional analyses, opinions, and recommenda-tions of the former Executive Director for Operations to Comissioner Asselstine responding to questions concerning a staff paper, SECY-85-62. The documents do not contain any reasonably segregable factual portions and are being withheld in their entirety.

Pursuant to 10 CFR 9.9 and 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for the denial of paragraph four of the record identified at number one are the undersigned and Mr. Harold R. Denton, Director, Office of Nuclear Reactor Regulation. The person responsible for the denial of the document identified at number two is Mr. John C. Hoyle, Assistant Secretary.

Ms. Murphy -The denial by Mr. Denton and myself may be appealed to the Executive Director for Operations within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Executive Director for Operations, U.S.

Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial FOIA Decision." The denial by Mr. Hoyle may be appealed within 30 days to the Secretary of the Commission and should be addressed to the Secretary of the Commission.

This is a request under the Freedom of Information Act, as amended, for the following information:

(1) All internal NRC documents relating to IE Information Notice No. 86-05, (2) all internal NRC documents related to the operability of main steam safety valves (MSSV), their safety, tested failures, ring setting adjustments; (3) all internal NRC documents concerning actions toward determining additional requirements for MSSV operability; (4) all internal NRC documents concerning actions toward designation issue; of MSSV failure a high priority safety I

(5) correspondence between the NRC and MSSV manufacturers concerning MSSV safety, maintenence instructions, and reliability.

The information being requested will be used by interested members of the public and will be brought to the attention of members of Congress, NRC Commissioners and other state and local officials. Because no personal financial benefit will ensue, I hereby request waiver of the search and copy costs.
