A.      GENERAL

Sealed Source and Device (SS&D) Evaluation Program.-
Reporting Period: December 12, 2014 - June 11, 2021 During the 2014 IMPEP of the SS&D Program the review team made one recommendation: The review team recommends that the Branch develop and implement a mechanism to obtain missing historical documents referenced in the Sealed Source and Device (SS&D) registration certificates transferred from the State of Georgia. In response to the recommendation the staff, worked with the State of Georgia and certificate holders to locate the missing historical documents. The staff summarized their efforts and results in a memorandum dated January 20, 2016 (ML16006A273).
Region I - Reporting Period: April 4, 2015 - June 11, 2021 The 2015 Region I IMPEP report included no comments or recommendations. The report from the Periodic Meeting in February 2018 indicated performance was satisfactory with no performance concerns or issues identified.
Region III - Reporting Period: July 22, 2017 - June 11, 2021 There were no recommendations from the previous Region III IMPEP in 2017.

Staff in uranium recovery licensing use Inspection Manual Chapter (IMC) 1248, Appendix I. This document is entitled Training Requirements and Qualification Journal for Uranium Recovery Project Managers/Technical Reviewers and is available at: https://www.nrc.gov/reading-rm/doc-collections/insp-manual/manual-chapter/index.html IMC 1248, Appendix I was revised in July 2019 to include three new required courses: (1) National Environmental Policy Act for the Uninitiated; (2)
MARSAME: Multi-Agency Radiation Survey and Assessment of Materials and Equipment (H-120); and (3) MILDOS Area Dose Assessment Code (Argonne National Laboratory). Additionally, the July 2019 revision included references to NUREG 1620 - Standard Review Plan for the Review of a Reclamation Plan for Mill Tailings Sites Under Title II of the Uranium Mill Tailings Radiation Control Act of 1978 and NUREG 1623 - Design of Erosion Protection for Long-Term Stabilization.
Low-Level Waste uses NMSS Policy and Procedure #1-13 that is based off the respective IMCs on June 7, 2019. The Policy and Procedure facilitates office ownership of the qualification process outside of the Inspection program. The Low-Level Waste Project Manager Qualification Journal is available in Agencywide Documents Access and Management System (ADAMS at ML16139A402.

Region I uses the IMC 1248 guidance for qualification and training requirements. In addition, Region I implements and maintains Region I, Division of Nuclear Materials Safety (DNMS) Directive 0400/3, DNMS Training and Qualification Program. Revision 3 was implemented on March 3, 2021, to include the most recent references and guidance. Also, Attachment 3 of DNMS Directive 0400/3, Licensing Signature Authority -
Level I & II Groups has been updated to better reflect the program codes contained within the Web-Based Licensing system.
Region III has adopted IMC 1248 for the qualification of Materials Inspectors (Appendix B), Decommissioning Inspectors (Appendix F), Decommissioning Reviewers (Appendix G), and Licensing Reviewers (Appendix A).

Low-Level Waste currently has 3 vacancies. Management is planning on utilizing programs such as Nuclear Regulator Apprenticeship Network (NRAN)
Program and Co-Op and Summer Intern programs as possible replacement candidates.
Region I has 1 vacancy in the Commercial, Industrial, R&D, and Academic Branch. Two Vacancies in the Commercial, Industrial, R&D, and Academic Branch. One vacancy for Division support. Additionally, by applying the NRCs Strategic Workforce Planning tool, Region I management decided to hire ahead 4 positions in the Medical and Licensing Assistance Branch in anticipation of future losses within the division. These positions will allow new staff to complete a substantial portion of the qualification program before the anticipated retirements occur. Management is currently reviewing applications and conducting interviews for the positions. Based on current budget predictions for fiscal years 2022 and 2023, division staffing levels will remain approximately the same as current staffing levels. Division management continues to assess budget and resource needs and make proactive hiring decisions.
Region III has 3 vacancies in DNMS at the time of the review. One vacancy in the Materials Inspection Branch (MIB), one vacancy in the Materials Control ISFSI and Decommissioning Branch (MCID), and one vacancy in the Materials Licensing Branch (MLB). MCID Health Physicist - MCID has 1 FTE vacancy that has been vacant since January 2021. MCID posted a solicitation of interest (SOI) agency-wide and did not hire anybody out of that SOI. MCID posted an SOI for external hires that closed in April 2021.
MCID has interviewed for the position and expects to make a selection soon. MIB Health 4
 
Physicist - The 1 FTE vacancy in MIB has been vacant since the end of March 2021 due to the retirement of Keven Null. MIB intends to post an SOI agency-wide to fill the one vacant position in the branch. MLB Health Physicist - 1 FTE vacancy that has been vacant since March 2021- MLB posted a SOI agency-wide and did not hire anybody out of that SOI. MLB posted for an external hire and is reviewing the applicants.
Region IV has 1 GG-13 license reviewer vacancy in Materials Licensing Decommissioning Branch as of April 2021. An Agency-wide solicitation of interest was posted and applicants are currently under review. The MIB does not currently have any vacancies, however, the Division will review the need for additional staff as needed for attrition.

Low-Level Waste disposal facilities are located in Agreement States, as such the respective Agreement States perform inspection activities. For the radium program, all 58 non-military sites were dispositioned by 2019, and dates of site visits and scoping surveys are provided as part of the page on letters to site owners on NRCs public webpage for radium (https://www.nrc.gov/materials/radium/non-military-radium-letters.html). None of the radium sites, neither military nor non-military, are licensed per Commission direction and, therefore, IMC 2800 does not specify a priority for inspecting them. However, the sites are generally similar to decommissioning sites and inspected or observed on an as needed basis.

The Regions conduct its inspection program in accordance with inspection procedures and guidance developed by NMSS, including revisions made during the reporting period. The guidance provided in current NRC Inspection Manual Chapter 2800 is primarily used. IMC 2800 was last updated in March 2020.

Region I has an ample supply of calibrated instruments available to inspectors for use during inspections. Instruments are sent to a qualified calibration company via an annual contract. Instrument and detector types capable of detecting alpha, beta, gamma and neutron radiation, include: ion chambers (6) ,
pancake probes (7), Sodium-Iodide scintillation probes (12), side window Geiger-Muellers (4), end window Geiger-Muellers (4), alpha detectors (3), microR meters (10), personal alarming rate meters (6), a neutron meter, and an isotope identifier. Region I does not have in-house laboratory capabilities. Samples collected in the field are sent to Oak Ridge Institute for Science and Education for analysis.
The Region III maintains a variety of instruments from simple hand-held dose rate instruments to more complex instruments used for decommissioning purposes which consist of ion chamber, Geiger-Mueller, scintillation, gas flow proportional detectors, etc. In addition to the Region IIIs internal instruments, Region III uses, as necessary, its contractor the Oak Ridge Institute for Science and Education (ORISE) to perform confirmatory surveys at decommissioning 7
 
licensee facilities. For soil, water, and/or vegetation samples, the region uses the ORISE laboratory for sample analysis. The instrument program is maintained in accordance with Regional Procedure 10.131, Protection of Region III Employees Against Ionizing Radiation. Region III does not maintain any calibration or laboratory capabilities. Region III uses a vendor (Laurus) to calibrate and repair its instruments. All calibrations are performed with NIST traceable sources. Instruments are calibrated at least annually, or prior to use, and any instruments that are out of calibration are stored in a labeled cabinet or have a tag attached to them indicating that they are out of calibration.
Calibration due dates are tracked by the Radiation Safety Officer (RSO) and instruments are sent for calibration typically once or twice per quarter. Region III maintains a sufficient inventory of survey instruments to ensure that inspection activities are not affected by instrument exchanges for calibration. Instruments not used on a routine basis are calibrated as needed. Region III provided a table for their survey instrument capabilities. See Appendix L.
The Region IV office maintains a variety of instruments to accommodate the different needs of the inspectors. The instrumentation is capable of measuring ambient exposure rates and surface contamination levels. Region IV maintains instrumentation that can measure both alpha and beta-gamma surface radioactivity levels. Although rarely used, Region IV also maintains a FIDLER for measurement of low energy radiation (Am-214, depleted uranium) in outdoor settings. The instrumentation is calibrated annually, in accordance with the Regional Radiation Safety Manual (a Regional Office Policy Guide),
by offsite contractors. Region IV uses three different contractors based on the level of complexity and the manufacturer of the instrument. Region IV also maintains some instrumentation in storage that is no longer calibrated. These meters are occasionally used for spare parts, or could be returned to service, if needed. Region IV maintains several check and calibration sources for functional checks and for efficiency calculations.
Region IV maintains a logbook of instrument calibration due dates and issuance of meters to the inspectors. The location of any meter at any time can be verified through the logbook. When an instrument is coming due for calibration, the laboratory manager will issue emails to recall the instruments for recalibration. Region IV no longer maintains the ability to measure neutron exposure rates. Any inspector requests for neutron exposure measurements would have to be conducted by the licensee at the request of the inspector. A common example would be during cannister loading operations at nuclear power plants. Finally, Region IV maintains sampling equipment for collection of swipe samples and environmental samples. Region IV no longer maintains the capability to analyze swipe, soil, or water samples. These samples are submitted to a contracted Department of Energy (DOE) laboratory in Idaho for analysis. Chain of custody forms are used to maintain control of the samples.
IV. Technical Quality of Licensing Actions

For Sealed Source and Device there are 157 active sealed source and device registration certificates. See Appendix N for specific radioactive material licenses.
As of March 24, 2021, Region I regulates 697 specific radioactive materials licenses. As of February 17, 2021, Region III regulates 872 active licenses.
The total includes one Master Materials license, 17 priority 1 licenses, 135 Priority 2 licenses, 143 priority 3 licenses, and 576 Priority 5 licenses. As of April 20, 2021, according to Web-Based Licensing Report 4, Region IV regulates 509 total licensees which includes one Master Materials License.
The Low-Level Waste and Projects Branch (LLWPB) is responsible for the NRCs radium program. For the radium program, there are no specific radioactive material licenses currently. Instead, per Commission direction, the NRC staff has pursued graded approaches for involvement at the various military and non-military sites.
For the military radium program, the Commission, in SRM-SECY-14-0082, directed the staff to establish, through a memorandum of understanding, a consultation process for sites with unlicensed Atomic Energy Act material being cleaned up by the U.S. Department of Defense (DOD) per its responsibilities under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) and the Defense Environmental Restoration Program (DERP). The purpose of the consultation process is to ensure DODs CERCLA/DERP remedies also meet NRCs release criteria specified in 10 CFR Part 20, namely 10 CFR 20.1402 for unrestricted release, and 10 CFR 20.1403(b) for restricted release. Two approaches are employed for the consultation process depending on the level of oversight by the U.S.
Environmental Protection Agency (EPA):
* For sites on the National Priorities List (NPL), EPA is the lead federal oversight authority and NRC, at these sites, stays-informed of the staff would take a limited involvement approach to stay informed and would rely on the CERCLA process and EPA regulatory oversight. The staff maintains a general understanding of the progress and views on important radiological remediation issues as well as the completed and planned activities of each organization. This approach does not involve licensing and accordingly the staff does not conduct licensing reviews. However, the NRC reserves the option of providing comments to EPA on the military remediation, if necessary, to justify continued reliance on the CERCLA process and EPA oversight.
* For sites where there is no federal oversight conducted by EPA (e.g., sites not listed on the NPL), the NRC would monitor DODs cleanup. Monitoring uses a graded approach to prioritize these sites and conduct the appropriate type and amount of monitoring activities for each site based on its priority. This approach does not involve licensing, however, the purpose of this monitoring would be to provide consistent federal oversight to confirm that DODs remediation of radioactive material using the CERCLA process would result in an outcome that is protective of public health and safety and the environment. To accomplish this, NRC monitoring determines that NRCs 25 mrem/yr dose criterion in 20.1402 is not exceeded for sites planning for unrestricted release. For sites planning to leave contamination on-site with restrictions on future land use and/or 9
 
engineered controls, NRC monitoring would determine that the 25 mrem/yr dose criterion in 20.1403 (b) with institutional controls in place is not exceeded and that the plans for 5-year reviews required by CERCLA and their implementation are acceptable to ensure long-term protection.
During the review period, the number of DOD sites that NRC has been involved at has varied as follows: 2021: 21 sites; 2020: 17 sites; and 2019:
10 sites; NRC began issuing State and Tribal Programs (STP) letters to communicate with the States on which DOD sites it will be involved at:
STP-21-016 and STP-20-025. Listings of the specific DOD sites can be found in those letters.
For the non-military radium program, the Commission directed staff in SRM-SECY-17-0026 to (1) monitor under a memorandum of understanding with the EPA (should an MOU become necessary) and, as appropriate, separate site-specific agreements at sites undergoing remediation through relevant, existing, State and Federal programs and (2) use of a risk-informed, graded approach to either license, work cooperatively with site owners using a letter of forbearance, or not pursue any further action. During the review period, NRC revised its MOU with the National Park Service for involvement at NPS properties in New York undergoing cleanup for unlicensed AEA material, bringing the number of NPS sites with NRC involvement to three: Great Kills Park, Spring Creek Park, and Dead Horse Bay.
At the remaining non-military radium sites, NRC staff completed dispositioning all 47 original sites with historical radium contamination as well as 11 additional sites which were identified in subsequent efforts in Michigan and Connecticut. Of the 58 sites, 5 were determined to require cleanup and 1 additional site was found to exceed the number of gauges permitted under a general license. The five sites are the former Benrus, New Haven, Sessions, Seth Thomas, and Waterbury clock factories in Connecticut. The site with excess gauges is the Air Zoo Museum in Michigan. The NRC staff issued letters of forbearance after receiving commitments by site owners to implement voluntary controls and cleanup their respective sites. The Benrus and Sessions sites have been cleaned up and closed out by NRC staff in 2019 and 2020, respectively, and the Air Zoo site disposed of the excess to remain a general licensee in 2021. The New Haven site anticipates completing cleanup later in 2021. Two of the remaining sites, Waterbury and Seth Thomas, have submitted cleanup plans. Waterbury also has another portion of its site that is being evaluated by the EPA for inclusion on the NPL.

Two Sealed Source and Device workshops were conducted to train Agreement 10
 
State and NRC staff to conduct Sealed Source and Device safety evaluations.
In addition to the workshops, NRC staff provided a focused refresher training to staff from the State of North Carolina. Experienced Sealed Source and Device reviewers from the NRC and the Agreement States presented the lectures at the workshops. Agreement State staff provided strong support and participation in presenting lectures at each of the Workshops.
Sealed Source and Device Cases:
: 1. SSD 15-04 (Theragenics), this was for a new device that allowed for the standing of seeds at medical facilities.
: 2. SSD 15-23 (Eckert & Ziegler), this was for a prostate seed, that the applicant had to demonstrate alternative prototype testing.
: 3. SSD 15-40 & SSD 16-18 (CESCO), this was a device that was originally registered as a generally licensed device California. The applicant applied to the NRC to request it be registered as an exempt product.
: 4. SSD 17-27 (Hopewell Designs, Inc.), we have received several Sealed Source and Device applications from this applicant for different types of calibrator and irradiators.
: 5. SSD 19-02 and 19-03 (Varian), this was for a new HDR and sealed source.
Sealed Source and Device Workshops:

The NRC staff supported the development of the first Safety Evaluation Report for the NorthStar Medical Radioisotopes LLC, RadioGenixTM System Model 1.0a on March 15, 2018. The NRC staff used the analytical techniques in NUREG-1556, Volume 3, Revision 2. It should be noted that while the techniques from Volume 3 were used, the system did not meet the definition of a device.
As part of technical assistance request from the State of North Carolina, the staff performed the concurrence evaluation for CivaTech Onology, Inc. for the CivaDerm product (SSD 20-17 Civatech Oncology).
We served as IMPEP team members for the review of the Sealed Source and Device program in five Agreement States: Florida in 2015; Maine in 2015; North Carolina in 2018; Florida in 2019; Maine in 2019, New Hampshire 2021 and Tennessee 2021.
In September 2015, the staff completed the revision of the Sealed Source and Device guidance in NUREG-1556, Volume 3. Agreement State Staff supported the revision.

Uranium Recovery has one license renewal application that has been pending for more than one year. A set of unique circumstances exists for this license. Uranium Recovery 12
 
issued Source Material License SUA-1580 to Hydro Resources, Inc. (HRI) in January 1998 for uranium production at the Crownpoint Uranium Project using the in situ recovery method. After the initial license was issued in 1998, the NRCs licensing decision was subject to a lengthy NRC Atomic Safety and Licensing Board review, Commission review, and Federal Court review. All legal reviews were completed in November 2010. In August 2002, during the course of the legal reviews, HRI requested renewal of license SUA-1580. The application was deemed timely filed. In March 2013, HRI submitted an updated Environmental Report (ER) and Consolidated Operations Plan (COP),
revision 3.0, to the NRC in support of its request for license renewal. In February 2014, HRI submitted a letter indicating that it was negotiations with the Navajo Nation and would provide updates to the ER and COP by June 2014. On February 5, 2014, and September 16, 2014, HRI requested additional time to complete its discussions with the Navajo Nation Council prior to submitting a revised license renewal application. On November 13, 2014, the NRC staff placed its review of the license renewal application in abeyance until further notice. In April, 2018, the licensee requested that the name on the license be changed to NuFuels, Inc. No construction or operation has occurred under the NuFuels, Inc. license for the Crownpoint Uranium Project. When NuFuels decides to proceed with the license renewal process, the staff will resume its review of the license renewal application.

The list of allegations that the Sealed Source and Device staff was involved is available in the files of the NRC Headquarters Allegation Team. The Sealed Source and Device staff routinely supports allegations involving the public sale 13
 
sites such as eBay and Amazon or for sales that involve licensed materials or licensing requirements. We responded to numerous eBay and Amazon sales during the review period. The Sealed Source and Device team receives and reviews the daily events report and determines whether the event is an Sealed Source and Device generic issue. The determination is based on the criteria in MD 6.4, Generic Issues Program. The team leader maintains a log of the events that were reviewed.
The Sealed Source and Device team also uses NMSS Policy and Procedure 2-6, Rev. 1:
Overview of Generic Communications Coordination and Processing. The Sealed Source and Device team performed an evaluation of events reported involving Electron Capture Devices (ECD) designed for use in Gas Chromatographs (GC) from 1991 to 2015. As a, result staff suggested a change in the expected useful life of ECDs to Agilent Technologies, this change was made in 2015 (ML15098A070). The Sealed Source and Device team identified, as an outcome of an event, that the issues regarding a missing lock washer in BSI Instruments, Inc. fixed gauge Model LB 7442-D could result in the source capsule coming loose due to vibration of the source, it was determined that this constituted a generic issue. As a result, staff issued Information Notice 2016-12, Potential Absence of Required Lock Washers in BSI Instruments, Inc. LB 7400 Series Fixed Gauges, dated October 20, 2016.
An event in Texas that involved a sealed source being removed from a fixed gauge was reviewed by NRC staff to determine whether there was a generic implication involving the manufacturing or design of the gauge. In response, as part of its review the Sealed Source and Device team issued a memo dated August 3, 2020 (ML20206L187) to the NMSS Office Director regarding the staffs review of the event.
