This refers to the recently enacted Comprehensive Anti-Apartheid Act of 1986.
Section 309(a) of the Act, " Prohibition on Importation of Uranium and Coal from South Africa", specifically prohibits the import into the United States of uranium ore and uranium oxide that is produced or manufactured in South Africa.
NRC's general license for imports in s110.27 now permits the import of unirradiated source or special nuclear material, including uranium ore and uranium oxide, from any country if the consignee in the United States is authorized to possess the material. To carry out Section 309(a), NRC must amend its regulations in 9110.27. The enclosed proposed rulemaking action would revise 5110.27 to delete the general license with respect to uranium ore and uranium oxide of South African-origin.
Since Section 309(a) becomes effective on January 1,1987, we would appreciate receiving the Executive Branch's comments and final recommendations on the rulemaking as soon as possible to allow NRC sufficient time to implement the rule by that date. Please note that, in view of the Executive Branch's greater, knowledge in this area, we have asked that you provide detailed comments for insertion in the Statement of Considerations regarding the impact of this rulemaking action on the public.

: The Nuclear Regulatory Commission (NRC) is amending its general license regulations for the import of uranium from South Africa. This action is necessary to implement a section of the Comprehensive Anti-Apartheid Act of 1986, enacted October 2, 1986, which specifically prohibits the imoort of uranium ore and. uranium oxide produced or manufactured in South Africa into the United States. The amended regulation deletes the general license to import uranium ore and uranium oxide produced or manufactured in South Africa.

SUPPLEMENTARY INFORMATION:
BACKGROUND On October 2,1986, Public Law 99-440, the Comprehensive Anti-Apartheid Act of 1986, was enacted to establish a framework to guide the efforts of the United States in helping to bring an end to apartheid in South Africa and lead to the establishment of a nonracial, democratic form of government. The Act imposes a wide range of measures against South Africa to undermine apartheid including sanctions covering the import of nuclear-related commodities from South Africa and the export of nuclear-related commodities to South Africa.
South Africa, as used in the Act, means any territory under the administration, legal or illegal, of South Africa and the "bantustans" or " homelands", to which                #
South African blacks are assigned on the basis of ethrac origin, including the Transkei, Bophuthatswana Ciskei, and Venda.
PR0HIBITION ON IMPORTS Section 309(a) of the Act specifically prohibits the import into the United States of uranium ore and uranium oxide that is produced or manufactured in South Africa. The NRC's import regulatic,ns in 10 CFR 110.27 currently permit a person to import byproduct material or unirradiated source or special nuclear material, including uranium ore and uranium oxide, from any country under
 
3 general license if the consignee in the United States is authorized to possess the material. To carry out section 309(a), the NRC is amending its regulations in 5110.27 to delete the general license to import uranium ore and uranium oxide from South Africa. " Uranium ore and uranium oxide produced or manufactured in South Africa" means uranium mined and uranium oxide manufactured from uran mined in South Africa and will be noted hereafter as South African-origin waterial. The ban on importation applies to direct imports of South African-origin material and indirect imports of South African-origin material.

The ban on importation also applies to South African-origin material proposed for import into the United States for a short period of time, such as for enrichment purposes, and then reexported to another country. En accordance w:th the Act, this revision to NRC's regulations will become effective on January 1,1987.

Since NRC does not have adequate information covering the impact, the Executive Branch is requested to add a paragraph regarding the impact of this rulemaking action on importers and internationally.)

4 Because this rulemaking action involves a foreign affairs function of the United States notice of proposed rulemaking and public procedure thereon are not required by the Administrative Procedure Act (5 U.S.C. 553(a)(1)). The Act requires that the rule must be made effective January 1, 1987.
PR0HIBITION ON EXPORTS Section 307(a) of the Act prohibits the export of NRC-licensed material and components to South Africa, except for those items now permitted for export i
under general license. The current NRC export regulations are sufficient to carry out this section because an exporter is required to obtain a specific license (except for those items now generally licensed) before exporting any NRC licensed material to South Africa. Therefore no amendments to the NRC regulations are necessary to carry out the Act with respect to the export of NRC-licensed material and components to South Africa.
ENVIRONMENTAL IMPACT: CATEGORICAL EXCLUSION The NRC has determined that the final rule in Part 110 is the type of            i action described in 10 CFR 51.22(c)(1). Therefore, neither an environmental
_ignact statement nor an environmental assessment has been prepared.

BACKFIT The NRC ha's determined that the backfit analysis provisions in 10 CFR 50.109 do not apply to amenoments to 10 CFR Part 110 because Part 110 apolies only to the export and' import of nuclear facilities, material, and components and does.not deal with domestic facilities. Therefore, a backfit analysis has not been prepared for this amendment.

The Treasury Department, in Executive Order 12571 of October 27, was delegated authority in the Executive Branch to implement the Act's provisions on the importation of uranium (Section The NRC, which has independent regulatory authority under the Atomic 309(a)).
Energy Act over the import of uranium, must also implement provisions in its regulations to conform with the requirements of the Act and ensure these provisions are parallel to the provisions of the Treasury Department's regulations.

(1) A contract with the Department of Energy; (2) An exemption from licensing requirements issued by the Comission; or (3) A general or specific license issued by the Commission or a State with which the Commission has entered into an agreement                                                        .
under Section 274b. of the Atomic Energy Act.

l (b) The general license in paragraph (a) of this section does not
.                                                authorize:
(1) The import of source or special nuclear material in the form of irradiated fuel that exceeds 100 kilograms per shipment; or                                                                      J-of (2) The import of uranium ore and uranium oxide produced or                                                            po/*

By the authority vested in me as President by the Constitution and statutes of the United States of America, including the Comprehensive Anti-Apartheid
]                                            Act of 1986 (Public Law 99-440) ("the Act"), and section 301 of Title 3 of the United States Code,it is hereby ordered as follows:
Section 1. Implementation of the Act. All affected Executive departments and agencies shall take all steps necessary, consistent with the Constitution, to implement the requirements of the Act.
I Sec. 2. Functions of the Department of State. The Secretary of State shall be responsible for implementing Sections 208, 302 (to the extent it relates to temporary imports), 303(b), 307(a)(2), 317, 318, 401(b)(2), 501(b), 504, 508, and 508 of the Act. Responsibility for transmitting the report required by Section 509 of the Act is delegated to the Secretary of State.
i Sec. 3. Functions of the Department of the Treasury. The Secretary of the
* Treasury shall be responsible for implementing Sections 301,302 (to the extent it relates to permanent imports),303,305,308,309,310,319,320,323(a)(1), and 510 of the Act.
Sec. 4. Functions of the Department of Commerce. The Secretary of Commerce shall be responsible for implementing Sections 304,321, and 502(b) of the Act.        l s
Sec. 5. Functions of the Department ofDefense. The Secretary of Defense shall l                                    be responsible for implementing Section 322 of the Act.
Sec. 8. Functions of the United States Trade Representative. %e United States Trade Representative shall be respo'sible for implementing Sections
      ;                                    323 (a)(2) and (b) of the Act and Section 402 (except for the imposition of g                                    import restrictions).
Sec. 7. Amctions of the AgencyforlaternationalDevelopment. %e Adminis-trator of the Agency for International Development shall be responsible for implementing Sections 210 (to the extent of determining the existence of food shortages only) and 505 of the Act.
Sec. 8. Functions of the Department of Transportation. The Secretary of Transpcrtation shall take the steps specified in Sections 306(a) (2) and (3).
Sec. 9. Definition of Strategic Minetuls. The Secretary of State shall be responsible,in consultation with the Secretary of Commerce and the Secretary of Defense, for determining which articles are strategic minerals within ti.e meaning of the Act.
Sec.10. Regulatory and Enforcement Authority. %e head of each agency assigned functions by this Order is delegated authority under Sections 001 and 003 of the Ar'. to the extent that they relate to functions delegated by this Order or conf _tred by the Act.
Sec.11. Coordination andPolicy Guidance. %e Secretary of State is responsi-ble for ensuring that implementation of the Act is effectively integrated with
      >                                  and la supportive of the foreign policy of the United States. In carrying out their respective functions and responsibilities, the head of each agency as-signed responsibility under this Order shall consult with the heads of other affected agencies.

Sec.12. Inter. Agency Coordinating Committee. An Inter. Agency Coordinating Committee on South Africa is hereby established, under the Chairmanship of the Secretary of State. The Committee shall also include the Secretary of the Treasury. Secretary of Defense Attorney General. Secretary of Commerce, Secretary of Transportation. Secretary of Agriculture, the United States Trade Representative, and other members as appropriate. The Committee shall serve as a forum for consultations on United States policy concerning South Africa and shall monitor implementation of the Act to ensure consistency with United States policy objectives.
Sec.13. Reservations of Functions. All authority not expressly delegated or granted herein is retained by the President. The President retains the authority to exercise any of the authority delegated or granted in this Order.              l Sec.14. Effective Date. This Order shall be effective immediately.

This memorandum seeks ED0 approval, in accordance with ED0 memorandum of May 30, 1984, for the staff to proceed with an amendment to 10 CFR Part 110.
The amendment is nec2ssary to implement Public Law 99-440, the Comprehensive Anti-Apartheid Act of 1986, which entered into force on October 2 and inooses a wide range of sanctions against South Africa. Section 309(a) of that Act,
          " Prohibition on Importation of Uranium and Coal from South Africa",
specifically prohibits the imoort into the United States of uranium ore and uranium oxide that is produced or manufactured in South Africa.
Currently, 110.27 permits the import of unirradiated source or special
  "      nuclear material, including uranium ore and uranium oxide, from any country if the consignee in the United States is authorized to possess the material.
The amendment to Part 110 would revise 110.27 to delete the general license to import source or special nuclear material contained in uranium ore and uranium oxide produced or manufactured in South Africa.
In accordance with that Act, Section 309(a) takes effect 90 days.after the enactment of the Act or on January 1, 1987. Therefore, the amendment to Part 110 should January          be published on a priority basis as a final rule effective 1, 1987.
There are no alternatives to the rulemaking action. A copy of the draft regulatory agenda entry is enclosed.
In accordance with E00 memorandum of May 30, 1984, your approval is requested to proceed with staff processing of the amendment.

With respect to the rulemaking, this is the information you requested to assist your office in its independent review of whether to proceed with the rulemaking action.

: 2. IP's staff recommendation concerning whether and how to proceed with rulemaking 4            IP believes NRC should proceed with the rulemaking action promptly because it is mandated by law. (Section 309(a) of Public Law 99-440 takes effect January 1,1987.)
: 3. Preliminary judgments by IP staff concerning:
)            a. The issue to be addressed, i.e.      the problem to be corrected.
Issue:
Section 309(a) of the Comprehensive Anti-Apartheid Act of 1986, Public L6w 99-440, specifically prohibits the import into the United States of uranium ore and uranium oxide that is produced or manufactured in South Africa.
The 3roblem:
The iRC's import    regulations in 10 C".110.27 currently permit a person to import byproduct material or unirradiated source or special nuclear material, including uranium ore and uranium oxide, from any country (including South Africa) under general license if the consignee in the United States is authorized to possess the material.

: b. The necessity and urgency for addressing the issue.
It is necessary for NRC to address the problem because our current regulations allowing the import of South African uranium ore and uranium oxide directly conflict with the law banning such imports from South Africa.
The issue should be addressed addressed promptly because Section 309(c) of the law takes effect January 1,1987.

: c. Alternatives to Rulemaking There are no alternatives to the ruiemaking action.
: d. How the issue will be addressed through rulemaking:
NRC will amend its regulations in 110.27 to delete the general license to import uranium ore and uranium oxide produced or manufactured in South Africa.
: e. How the public, industry, and NRC will be affected as a result of rulcmaking, including benefits and costs (risk, occupational exposure, and resources)
NRC could be affected because any imports of South African uranium ore and uranium oxide will now require specific licenses, therefore the workload may increase slightly to process such requests. In addition, the public will be making inquiries involving the interpretation of the law including the' scope and applicability of the law to which NRC must respond.
The rulemaking action will affect industry, i.e., Allied Chemical and Kerr-McGee. These companies convert uranium oxide U308 to UF6 for enrichment purposes. The ban will prohibit imports of South African material which the companies would normally be converting, therefore, their businesses would be affected. Also domestic commercial power reactors with current contracts to receive South African material will be affected,
: f. NRC resources and scheduling for the rulemaking.
Since NRC must implement this Section of the law, normal NRC resources will be involved. It will not be necessary for NRC to contact industry or the public. We are required to obtain final Executive Branch recomendation on this rule. In addition, we have requested the Executive Branch to assist the NRC with the language in the Statement of Considerations concerning the interpretation of the law and the impact of the rule on industry and the public.
: 4. A copy of the draft final rule in enclosed. You will note that IP has specifically requested the Executive Branch to provide additional infonnation concerning the scope and applicability of Section 309(c) of the Public Law 99-440 and how the law will affect the public and industry. Finally, this rulemaking action is mandated by law; therefore NRC must act promptly to implement the law.
