The U.S. Nuclear Regulatory Commission (NRC) issued Orders dated May 23, 2002, for alldecommissioning commercial nuclear power plants and independent spent fuel storage installations using wet storage, to immediately implement interim safeguards and security compensatory measures (ICMs). The Orders for each plant included a safeguards information (SGI) attachment containing specific ICMs to be implemented by the receiving licensee.Following issuance of the Orders, the Nuclear Energy Institute (NEI) Security Working Group(SWG) developed a draft industry guidance document involving SGI to facilitate licensee implementation of the specific ICMs contained in the Orders. The NRC staff conducted meetings with the NEI SWG at NRC headquarters specifically to discuss the draft implementing guidance.By letter dated May 29, 2002, NEI formally submitted two guidance documents entitled"Implementation Guidance for Interim Compensatory Measures for Decommissioning Facilities located inside a Reactor Protected Area for the Order Dated May 23, 2002," and "Implementation Guidance for Interim Compensatory Measures for Decommissioning Nuclear Power Plants with Fuel in the Spent Fuel Pool and Independent Spent Fuel Storage Installations Using Wet Storage in the Current Threat Environment for the Order Dated May 23, 2002." The NRC staff has completed its review of the NEI guidance dated May 29, 2002, and has determined that it provides an acceptable method for licensee implementation of the ICMs.As discussed in the Order cover letters, the Orders do not obviate the need for licensees tocontinue to meet the objectives of Security Level III described in NRC Information Notice 98-35, and maintain the effectiveness of existing security measures taken in response to the events of September 11, 2001.

REVIEW OF INDUSTRY GUIDELINES RELATED TO INTERIM COMPENSATORY MEASURES ASSOCIATED WITH THE MAY 23, 2002, SECURITY ORDERS TO DECOMMISSIONING FACILITIES AND INDEPENDENT SPENT FUEL STORAGE INSTALLATIONS USING WET STORAGE

Dear Mr. Beedle:

The U.S. Nuclear Regulatory Commission (NRC) issued Orders dated May 23, 2002, for all decommissioning commercial nuclear power plants and independent spent fuel storage installations using wet storage, to immediately implement interim safeguards and security compensatory measures (ICMs). The Orders for each plant included a safeguards information (SGI) attachment containing specific ICMs to be implemented by the receiving licensee.

Following issuance of the Orders, the Nuclear Energy Institute (NEI) Security Working Group (SWG) developed a draft industry guidance document involving SGI to facilitate licensee implementation of the specific ICMs contained in the Orders. The NRC staff conducted meetings with the NEI SWG at NRC headquarters specifically to discuss the draft implementing guidance.

By letter dated May 29, 2002, NEI formally submitted two guidance documents entitled Implementation Guidance for Interim Compensatory Measures for Decommissioning Facilities located inside a Reactor Protected Area for the Order Dated May 23, 2002, and Implementation Guidance for Interim Compensatory Measures for Decommissioning Nuclear Power Plants with Fuel in the Spent Fuel Pool and Independent Spent Fuel Storage Installations Using Wet Storage in the Current Threat Environment for the Order Dated May 23, 2002." The NRC staff has completed its review of the NEI guidance dated May 29, 2002, and has determined that it provides an acceptable method for licensee implementation of the ICMs.
