ISSUANCE OF CONFIRMATORY ORDER WITH PROPOSED IMPOSITION OF CIVIL PENALTY-$35,000 This is to inform the Commission that a publicly available Confirmatory Order will be issued on or about September 28, 2015, to Energy Northwest (EN) confirming commitments reached as part of an alternative dispute resolution (ADR) settlement agreement.
In a letter dated June 25, 2015, the NRC provided EN the results of the investigation and offered EN the opportunity to attend a predecisional enforcement conference or to participate in ADR.
The violation involved Nuclear Security Officers (NSOs) at Columbia Generating Station (CGS) being willfully inattentive while on duty, which resulted in them not meeting the requirement to be available at all times inside the protected areas for their assigned response duties, contrary to 10 CFR 73.55(k)(5)(iii).
In response to the NRCs June 25, 2015, letter, EN requested to engage in ADR to resolve the matter through mediation. EN agreed to take a number of actions. Those actions include, but are not limited to: (1) conducting a common cause evaluation, (2) revising its annual compliance and ethics computer-based training to address deliberate misconduct, (3) presenting at an industry forum to discuss the events that led to the confirmatory order, (4) conducting a targeted nuclear safety culture assessment, and (5) paying a civil penalty of $35,000.
It should be noted that the licensee has not been specifically informed of this enforcement action. The schedule of issuance and notification is:
