Moore on behalf of Global Nuclear Fuel - Americas, LLC, and requested that the information contained in the letter's Enclosure 1, as described below, be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (1 O CFR) | |||

VSP-SNC-HVl-16-082 RI, "Revised Response to NRC RAI for Hatch 2 Cycle 25 SLMCPR Submittal" A nonproprietary version of Enclosure 1 was provided as Enclosure 2 and can be found at ADAMS Accession No. ML16328A303. | |||
The affidavit stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons: | |||
(5) To address 10 CFR 2.390 (b) (4), the information sought to be withheld is being submitted to NRC in confidence. The information is of a sort customarily held in confidence by GNF-A, and is in fact so held. The information sought to be withheld has, to the best of my knowledge and belief, consistently been held in confidence by GNF-A, no public disclosure has been made, and it is not available in public sources. We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.390 and, on the basis of the statements in the affidavit, have determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure. | |||
Therefore, the version(s) of the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended. | |||
Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area.
