STATUS OF RECOMMENDATION: AUDIT OF NRCS REGULATORY ANALYSIS PROCESS (OIG-15-A-15)

REFERENCE:

DIRECTOR, OFFICE OF NUCLEAR MATERIAL SAFETY AND SAFEGUARDS, MEMORANDUM DATED APRIL 29, 2019 Attached is the Office of the Inspector Generals (OIG) analysis and status of the recommendation as discussed in the agencys response dated April 29, 2019. Based on this response and additional information provided, Recommendation 3 is closed. All recommendations in OIG-15-A-15 are now closed.

Audit Report AUDIT OF NRCS REGULATORY ANALYSIS PROCESS OIG-15-A-15 Status of Recommendations Recommendation 3: Update and implement the cost benefit guidance documents as planned in SECY-14-0002. Incorporate this guidance into office procedures by reference.

Agency Response Dated April 29, 2019: On March 29, 2018, the staff submitted to the Commission by a notation vote paper SECY-18-0042, Draft Final NUREG/BR-0058, Regulatory Analysis Guidelines of the U.S. Nuclear Regulatory Commission. Following Commission review and approval of Revision 5, the staff will issue the final NUREG and publish the document on the NRC public Web site. An internal announcement will be issued to inform staff when the document is finalized. On September 28, 2018, the staff issued Revision 3 of the Office of Nuclear Material Safety and Safeguards (NMSS) Policy and Procedures 6-10, NMSS Procedures for Preparation and Review of Rulemaking Packages, which includes a reference to NUREG/BR-0058. This reference results in the incorporation of the approved cost benefit guidance into office policies and procedures.

Target Completion Dates:

April 2018 (completed) - issued notation vote paper with Revision 5 to NUREG/BR-0058 September 2018 (completed) - issued NMSS Policy and Procedure 6-10, Revision 3 OIG Analysis: OIG reviewed additional documentation provided by a representative of NMSS. The staff has informed the Commission and Congress that it is using the draft final NUREG to perform its regulatory analysis. It is documented in the monthly report to Senator Barrasso, Status Report on the Licensing Activities and Regulatory Duties of the U.S.

Nuclear Regulatory Commission For the Reporting Period through March 2019 (sent through the Commission). In this document the staff states the draft final NUREG is available for interim staff use and that in conducting its regulatory analyses, the staff is implementing the best practices and lessons learned that are contained within the NUREG.
