OFPUBLICMEETINGWITHTHENUCLEARENERGYINSTITUTE(NEI)ANDTHEPUBLICREGARDINGPOWERREACTOR DECOMMISSIONINGRULEMAKINGISSUESOnNovember27,2000,theNRCstaffmetwithrepresentativesofNEIandmembersofthepublictoreceivefeedbackaboutongoingNRCeffortstodeterminetheriskposedby permanentlyshutdownnuclearpowerplantsandthestatusofNRCeffortstoamendits regulationstoproperlyreflecttheriskposedbythesefacilities.Themeetingagendais providedinEnclosure1.Anadditionalagendatopicassociatedwithagenericissuerelatedto aMaineYankeesecurityexemptionrequestwasrequestedbyNEIatthebeginningofthe meeting.AlistofattendeesisprovidedinEnclosure2.NRCbeganthemeetingbystatingthatthespentfuelpoolriskstudybeingpreparedbytheNRCTechnicalWorkingGrouphadnotbeenfinalizedandwascurrentlywiththeOfficeofthe ExecutiveDirectorforOperationsforconcurrencepriortobeingsubmittedtotheCommission.

ThedraftversionoftheriskstudywasissuedFebruary2000(ADAMSAccessionNo.

ML003683371).NEIthendiscussedindustryconcernsassociatedwiththespentfuelpoolriskstudyandtheapplicationoftheriskstudyconclusionstotheintegrateddecommissioningrulemaking.NEI firstdiscussedtheseismicriskassessmentmethodologyusedintheriskstudy.NEIstatedthat ithadaconcernthatbyusingboththeLawrenceLivermoreNationalLaboratoryandElectric PowerResearchInstituteseismichazardcurvesinassessingtheseismicrisk,theNRCstaff wouldbasedecisionsonthemostconservativecurveandthusineffectwouldnotdetermine the"bestestimate"risk.TheNRCagreedthatthepurposeoftheriskstudywastodetermine the"bestestimate"risk;however,theNRCdisagreedthateithercurvewasconsideredmore valid.NRCstatedthatbothcurveswereequallyvalid,andtherefore,bothwerepresentedin theriskstudy.NEIstatedthatitwouldhavetoreviewtheriskstudyoncefinalized,andthen maysuggestthattheNRCdetermineamethodologytocombinethetwoseismichazardcurves todeveloponecurve.Next,NEIstatedthattherutheniumreleaseduringanuncontrollableheatupofthefuelafteralossofwaterinthespentfuelpoolwasoverestimatedintheriskstudy.NEIbelievedthatthe fuelinthespentfuelpoolwould,underaccidentconditions,actsimilartoa"slumpedcore"and thuslimittheamountofoxygenavailable,resultinginarutheniumsourcetermsimilartothat describedinNUREG-1465,"AccidentSourceTermsforLight-WaterNuclearPowerPlants."

NEIstatedthatitwouldprovidealettertotheNRCdocumentingthetopicaddressedabove.

TheNRCstaffstatedthatitwouldreviewtheletterasappropriate;however,tworuthenium sourcetermswereconsideredintheriskstudy,theNUREG-1465sourcetermandahigher sourceterm.NEIthendiscussedtheuseofadiabaticheatupinriskstudycalculations.NEIcontendedthattheuseofanadiabaticheatupresultsinabounding,conservativeanalysisandnota"best estimate"riskassessment.TheNRCstaffnotedthattheadiabaticheatupwasusedsincea better,defensibleanalysiswasnotavailable.TheNRCstaffalsonotedthattheheatup analysiswasusedonlyfordeterminationofthetimingoftheevent.NEIrequestedthatthestaffensuretheriskstudyisclearinthattheadiabaticheatupwasusedonlyfordeterminationofthe timingoftheevent.Next,NEIdiscussedarecentissueassociatedwiththeprocessforobtainingNRCapprovalforsubstitutionofthe10CFR73.51independentspentfuelstorageinstallation(ISFSI)specific licensesecurityrequirementsforthe10CFR73.55generallicensesecurityrequirementsatthe MaineYankeeISFSI(NEIhandoutinADAMSunderAccessionNo.ML003772839).TheNRC staffstatedthatareviewandapprovalprocessforthisrequestedtransitioniscurrentlybeing developedandtheindustrywouldbeinformedoncetheprocessisfinalized.NEIandmembersofthepublicweregivenanopportunitytoaskquestionsandthenthemeetingwasconcluded./RA/DavidJ.Wrona,ProjectManager DecommissioningSection ProjectDirectorateIV&Decommissioning DivisionofLicensingProjectManagement OfficeofNuclearReactorRegulationProjectNo.689
