-05 Mr. Kline The NRC is reviewing NEI 09

-05 as requested in your letter dated November 1, 2012.

You state that NEI 09

-05 is "SECURITY

-RELATD INFORMATION

- WITHHOLD UNDER 10 CFR 2.390." The NRC does not believe that the document is proprietary in its entirety.

There are items in it that can be publicly found or have been used in public forums.

NEI is asked to clearly show the information in the document that is deemed proprietary.

Please send directly to me via email a marked up version of the document with the proprietary markings in place.

If the NRC agrees with the markings, the information will be redacted. The NRC response to the letter will contain two versions (one proprietary and one non

-proprietary) of the document.

The NRC has to be as publicly transparent as possible.
