Davis-Besse Nuclear Power Station, Unit 1 Docket Number 50-346, License Number NPF-3 Notification of Completion of Actions for Confirmatory Order EA-16-022 5501 North State Route 2 Oak Harbor, Ohio 43449 419-321-7676 Fax: 419-321-7582 On September 1, 2016, the NRG issued a Confirmatory Order to the FirstEnergy Nuclear Operating Company (FENOC) modifying the Davis-Besse Nuclear Power Station (DBNPS) license. This Confirmatory Order was the result of an agreement reached during an alternative dispute resolution (ADR) mediation session conducted on July 21, 2016. Per Section V.9 of the Confirmatory Order, FENOC is required to provide written notification of the completion of actions taken under Items 1, 2, 3, 6, 7, and 8 of Section V of the Confirmatory Order no later than March 1 , 2017. These actions are complete as detailed in the attachment to this letter. There are no new regulatory commitments contained in this letter. Completion of Actions for Confirmatory Order EA-16-022 cc: NRC Document Control Desk DB-1 Senior Resident Inspector RECEIVED MAR 0 2 2017 Attachment L-17-060 Davis-Besse Nuclear Power Station (DBNPS) Completion of Actions for Confirmatory Order EA-16-022 Page 1of3 The following actions as documented in the Section V of the Confirmatory Order issued September 1, 2016, with an effective date of 30 calendar days after issuance (October 1, 2016), to the FirstEnergy Nuclear Operating Company (FENOC) have been completed as shown below: 1. Within 60 days of the effective date of the Confirmatory Order, Davis-Besse operations management will complete discussions with each licensed operator regarding the facts and lessons learned from the event that gave rise to the Confirmatory Order. The Operations Manager, or designee, completed discussions with each DBNPS licensed operator regarding the facts and lessons learned from the event that gave rise to the Confirmatory Order. These discussions were completed during the weekly Operations Manager's Hour portion of Cycle 16-02 Licensed Operator Continuing Training in the months of June, July, and August 2016. Discussions were held with the two licensed operators that did not attend these training sessions by the end of November, 2016. 2. No later than December 31, 2016, FENOC will revise operator requalification training materials to incorporate facts and lessons learned from the event that gave rise to the Confirmatory Order. Operator requalification training materials have been revised to incorporate facts and lessons learned from the event that gave rise to the Confirmatory Order. Cycle 16-03 of Licensed Operator Requalification Training, which concluded at the end of November 2016, included the objective to "Recall the expectations to comply with NRC medical requirements for licensed operators." The training included background information, standards for performance, and individual accountability.
The training material for Licensed Operator Requalification Training regarding medical requirements to be presented in 2017 (Cycle 17-04 or 17-05) was revised prior to the end of November, 2016, to include the objective "Understand lessons learned which led to an NRC Confirmatory Order and associated commitment DB-EA-16-022." 3. No later than December 31, 2016, appropriate FENOC management will communicate expectations and requirements for complete and accurate medical reporting to operations and security personnel subject to those requirements.
For licensed operators at the DBNPS, the expectations and requirements for complete and accurate medical reporting were discussed as part of the discussions held for Attachment L-17-060 Page 2 of 3 action item 1 described above. For DBNPS Site Protection personnel, required reading was issued of the initial DBNPS NRC Inspection Report 0500346/2016008 dated May 17, 2016, to communicate the expectations and requirements.
This required reading completed by June 10, 2016. For licensed operators at the Beaver Valley Power Station (BVPS), the expectations and requirements for complete and accurate medical reporting were discussed as part of Licensed Operator Continuing Training 2016 Cycle 5 completed December 9, 2016. For BVPS Site Protection personnel, required reading of these expectations and requirements were instituted on December 30, 2016, so that each crew member received the communication prior to taking their assigned watch. This required reading was completed on February 22, 2017. For licensed operators at the Perry Nuclear Power Plant (PNPP), the expectations and requirements for complete and accurate medical reporting were discussed during training provided by the end of September, 2016. For PNPP Site Protection personnel, the expectations and requirements were discussed during training provided by the end of December 2016. 6. No later than December 31, 2016, FENOC will revise existing fleet procedures governing the update of licensed operators' medical reports. The revised procedure will state that the licensed medical physician may request that the operator submit prescription purchase records or receipts, if the physician deems appropriate.
The FENOC fleet procedure governing the update of licensed operators' medical reports was revised effective November 11, 2016, to permit the Company Licensed Medical Physician to require licensed operators to submit purchase records and or receipts for prescribed medications on an as needed basis. 7. Within 30 days of the Agreement in Principle, FENOC will make a presentation at the Nuclear Medical Resources Professionals User Group to engage industry personnel from across the entirety of the United States on the facts and lessons learned from the event that gave rise to the Confirmatory Order. The DBNPS Regulatory Compliance Supervisor gave a presentation at the Nuclear Medical Resource Professionals (NMRP) User Group Conference held August 2-4, 2016, to discuss the facts and lessons learned from the event that gave rise to the Confirmatory Order.
Attachment L-17-060 Page 3 of 3 8. No later than December 31, 2016, FENOC shall submit an article to a widespread trade publication based on the facts and lessons learned from the event that gave rise to the Confirmatory Order. FENOC shall provide to the Director, Division of Reactor Safety, NRC Region Ill, a draft of the article 30 days prior to the submittal.
On December 29, 2016, the article "The Importance of Maintaining Medical Qualifications by a Licensed Operator" was submitted to a FENOC representative of the Professional Reactor Operator Society (PROS) for publication in The Communicator (the publication/newsletter of PROS). A draft of this article had been submitted to the Director, Division of Reactor Safety, NRC Region Ill, on December 1, 2016 (FENOC Letter L-16-347).
Based on the above descriptions, Items 1, 2, 3, 6, 7, and 8 of Section V of the Confirmatory Order issued September 1, 2016 are complete.
In accordance with Item 1 O of Section V of the Confirmatory Order, FENOC will provide written notification of the completion of actions taken under Items 4 and 5 no later than December 31, 2018.}}
