In the referenced Regulatory Issue Summary (RIS), the NRC communicated their plan to address the situation created when some containment atmosphere gaseous radioactivity monitors are unable to meet technical specification (TS) requirements. As stated in the RIS, "The NRC plans to address the issue of inoperable containment atmosphere gaseous radioactivity monitoring systems in an integrated fashion by: (i) working with the TSTF to develop revised generic TS for the monitoring system, and facilitating licensee implementation of the revised generic TS through a streamlined license amendment process; and (ii) issuing guidance on NRCs exercise of enforcement discretion involving inoperable containment atmosphere gaseous radioactivity monitoring systems." The referenced Enforcement Guidance Memorandum (EGM-09-001) states that the generic resolution of this issue will include development of model License Amendment Requests (LARs), model safety evaluations, and model no-significant-hazards consideration determinations using the NRC Consolidated Line Item Improvement Process (CLIIP). Both the RIS and the EGM reference TSTF-513, "Revise PWR Operability Requirements and Actions for RCS Leakage Instrumentation" and a similar BWROG Traveler under development, which is TSTF-514, "Revise BWR Operability Requirements and Actions for RCS Leakage Instrumentation." These Travelers were submitted to the NRC for review on February 18, 2009.

TSTF 09-05 February 18, 2009 Page 2 The TSTF requests that the NRC's review of TSTF-513 and TSTF-514 be granted a fee waiver pursuant to the provisions of 10 CFR 170.11. These Travelers meet the exemption requirement in 10 CFR 170.11(a)(1)(iii), in that it is a means of exchanging information between industry organizations and the NRC for the specific purpose of supporting the NRC's generic regulatory improvements or efforts. In this case, the generic regulatory improvement effort is the NRCs resolution of containment atmosphere gaseous radioactivity monitor Operability. The role of the TSTF Travelers in the NRC's generic regulatory efforts is explicitly acknowledged in RIS 2009-02 and EGM-09-001.
