Request for Exemption from the Biennial Emergency Preparedness Exercise Requirements in 10 CFR 50, Appendix E, IV.F.2.c In accordance with 10 CFR 50.12, "Specific exemptions," Exelon Generation Company, LLC (EGC), the licensee for Byron Station, is requesting U. S. Nuclear Regulatory Commission (NRC) approval of a one-time exemption from the requirements of 10 CFR 50, Appendix E, "Emergency Planning and Preparedness for Production and Utilization Facilities," Section IV.F.2.c. Specifically, EGC requests postponement of the evaluation of certain offsite elements of Byron Station's biennial Emergency Preparedness (EP) exercise, which was scheduled to be conducted on November 20, 2013. This exemption is requested as a result of the unavailability of the State of Illinois to participate in the exercise. State of Illinois resources were redirected following a series of tornados that struck another area of Illinois three days prior to the exercise.
On November 17,2013, Illinois was struck by a series of tornados. The tornados caused Significant widespread damage throughout the State that led to a Presidentially Declared Disaster for 15 Illinois Counties. Due to the magnitude of the State and Counties disaster response and impact to the resources, the Illinois Emergency Management Agency (I EMA) made the decision on November 18, to request postponement of the Byron Station biennial exercise scheduled for November 20. On November 18, lEMA notified the Federal Emergency lVIanagement Agency (FEMA) Region V and later received concurrence from the FEMA Region V Regional Assistance Committee chairman regarding the deferment. Since the State was not able to participate, Ogle and Winnebago Counties did not have the interface required from the State to be able perform their required functions; therefore, the Counties did not participate. The cancellation of the State and Counties participation in the EP exercise on November 20, 2013, resulted in Byron Station not meeting the criteria for full participation.
Accordingly, this exemption is being pursued as a result of the tornados which impacted the ability of lEMA, Ogle and Winnebago Counties to participate in the Byron Station biennial EP exercise on November 20,2013.

U. S. Nuclear Regulatory Commission December 10, 2013 Page 2  to this letter provides the detailed basis and justification for this exemption request and addresses the exemption requirements of 10 CFR 50.12 and the guidance criteria contained in Regulatory Issue Summary (RIS) 2006-03, "Guidance on Requesting an Exemption from Biennial Emergency Preparedness Exercise Requirements." Attachment 2 contains a letter from IEMA dated December 2, 2013, concerning the November 20, 2013, biennial EP exercises. contains a letter from FEMA dated December 7, 2013, concerning the deferral of the 2013 Byron Station EP exercise until February 2014.
EGC requests approval of the exemption by December 31,2013, based on the requirements for biennial EP exercise participation expiring at the end of 2013. This exemption request contains no new regulatory commitments.

ATTACHMENT 1 Request for Exemption Related to 10 CFR 50, Appendix E,Section IV.F.2.c Page 1 of 11 EXEMPTION REQUEST I. SPECIFIC EXEMPTION REQUEST In accordance with 10 CFR 50.12, "Specific exemptions," paragraphs (a)(1) and (a)(2)(v),
Exelon Generation Company (EGC), LLC is requesting NRC approval of a one-time exemption from the requirements of 10 CFR 50, Appendix E, "Emergency Planning and Preparedness for Production and Utilization Facilities," Section IV.F.2.c. Specifically, EGC is requesting to postpone and reschedule certain offsite functions of the Byron Station Emergency Preparedness (EP) biennial exercise from November 20, 2013, to February, 2014. This exemption request is being submitted as a result of the special circumstances caused by the severe weather conditions in Illinois prior to the scheduled exercise. The severe weather and associated response required by Illinois Emergency Management Agency (lEMA) personnel to the Presidentially Declared Disaster prohibited lEMA personnel from participation in the scheduled Byron EP exercise. This request for exemption is consistent with the guidance specified in Regulatory Issue Summary (RIS) 2006-03, "Guidance on Requesting an Exemption from Biennial Emergency Preparedness Exercise Requirements," dated February 24,2006.
10 CFR 50, Appendix E, Section IV.F.2.c stipulates the following:
: 2. The plan shall describe provisions for the conduct of emergency preparedness exercises as follows: Exercises shall test the adequacy of timing and content of implementing procedures and methods, test emergency equipment and communications networks, test the public alert and notification system, and ensure that emergency organization personnel are familiar with their duties.
: c. Offsite plans for each site shall be exercised biennially with full participation by each offsite authority having a role under the radiological response plan.
Where the offsite authority has a role under a radiological response plan for more than one site, it shall fully participate in one exercise every two years and shall, at least, partially participate in other offsite plan exercises in this period...
II. BASIS FOR EXEMPTION REQUEST The criteria for granting specific exemptions from 10 CFR 50 regulations are stated in 10 CFR 50.12. In accordance with 10 CFR 50.12(a)(1), the NRC is authorized to grant an exemption upon determining that the exemption is authorized by law, will not present an undue risk to the public health and safety, and is consistent with the common defense and security.
Furthermore, as stated in 10 CFR 50.12 (a)(2), special circumstances must exist for the NRC to consider granting an exemption. According to 10 CFR 50.12(a)(2)(v), special circumstances are present whenever the exemption would provide only temporary relief from the applicable regulation and the licensee or applicant has made good faith efforts to comply with the regulation.

However, severe weather, including tornados, struck Illinois on November 17, 2013, leading to a Presidentially Declared Disaster for 15 Illinois Counties with I EMA resources being allocated to the disaster response. The magnitude of the IEMA disaster response prohibited their scheduled participation in the 2013 biennial exercise at Byron. The natural disaster involving the tornados created special circumstances that precluded Byron Station of a full participation exercise.
I EMA, Ogle, and Winnebago Counties have indicated to EGC that rescheduling the specific functions later in the calendar year 2013 is not considered feasible due to the unavailability of their resources necessary to prepare for and conduct the offsite elements of the biennial exercise between now and the end of 2013.
Byron Station proceeded with onsite portions of the biennial exercise on November 20, 2013.
The list and table below provide details of the participants and functions which will be rescheduled to February 2014.

In accordance with 10 CFR 50.12, the NRC may grant an exemption from the requirements of 10 CFR 50 if the exemption is authorized by law. The proposed exemption is authorized by law in that no other prohibition of law exists to preclude the activities which would be authorized by the exemption. The proposed exemption will continue to serve the underlying purpose of the

The underlying purpose for conducting a biennial exercise is to test the adequacy of emergency plans, to ensure that emergency response organization personnel are familiar with their duties, and to identify and correct weaknesses. The activities performed during the last Byron Station biennial exercise in 2011, along with out-of-sequence drills and training demonstrate that the underlying purpose of conducting an exercise with participation from State and County authorities has been maintained.
: 2.      This exemption request will not present an undue risk to the public health and safety:
Adequate emergency response capabilities have been maintained and demonstrated including satisfactory performance during the last Byron Station biennial exercise in 2011 (July 27,2011) through the conduct of out-of-sequence training and activities. Since the last biennial exercise in 2011, Byron Station has conducted a number of training drills, exercises, and demonstrations that have involved actual and/or simulated interface with the State and County authorities.
While these drills and training sessions did not exercise all of the proposed rescheduled offsite functions, they do provide indication that Byron Station has maintained a continuing level of engagement with the State and County authorities to maintain interfaces.
State Evaluation with Other EGC Plants Since the July 27,2011, Byron Station Exercise, lEMA satisfactorily participated in the following FEMA evaluated exercises at other Illinois EGC plants:

There are no open deficiencies or Areas Requiring Corrective Actions (ARCA) for lEMA with any Illinois EGC plant at this time.

Byron Station Exercise The FEMA evaluation of the July 27,2011 exercise concluded that, "the offsite radiological emergency response plans and preparedness for the State of Illinois and affected local jurisdictions, site-specific to Byron Station, can be implemented and are adequate to provide reasonable assurance that appropriate measures can be taken offsite to protect the health and safety of the public in the event of the radiological emergency at the site." There were no Deficiencies identified during this exercise for the State of Illinois, Ogle or Winnebago County.
There were two ARCAs identified during this exercise: one for the State of Illinois and one for Ogle County. The State of Illinois received an ARCA finding under Evaluation Area 2, Radiological Assessment and Protective Action Recommendations and Decisions for the Plume Phase of the Emergency. This ARCA was demonstrated successfully and closed for the State of Illinois during the Clinton Power Station exercise on November 2,2011. Ogle County received an ARCA finding under Evaluation Area 3, Implementation of Protective Actions for Special Populations, School Evacuation. Prior to the scheduled Byron Exercise on November 20, 2013, training to resolve the issue surrounding the ARCA was held between the Ogle County Regional Office of Education, EGC and the State of Illinois. This ARCA was expected to be resolved during the November 20, 2013 exercise and will be part of the evaluation in the February 2014 rescheduled exercise.

: 3.       This exemption request is consistent with the common defense and security:
This exemption requests NRC approval to extend the schedule for performing certain offsite functions until February 2014 as a result of the tornados that struck the State of Illinois on November 17, 2013, and the impact on the State of Illinois on their resource availability to participate in the Byron Station scheduled exercise.
Pursuant to 10 CFR 50.12(a)(2), the NRC will consider granting an exemption from the requirements when special circumstances are present. This exemption request meets this requirement since special circumstances involving the tornados requiring the State's response are present.
Additionally, the exemption would provide only temporary relief from the 10 CFR 50, Appendix E, Section IV.F.2.c requirements. Rescheduled offsite functions will be evaluated during the 2014 Byron Station exercise. All other functions were performed and evaluated as originally scheduled on November 20, 2013.
Therefore, the common defense and security are not affected by this exemption request. The proposed change to the EP exercise schedule is not related to security issues and the common defense and security is not impacted.
III. ENVIRONMENTAL ASSESSMENT EGC has determined that the requested exemption meets the categorical exclusion in 10 CFR 51.22(c)(25), as the requested licensing action is an exemption 'from the requirements of the Commission's regulations and (i) there is no significant hazards consideration; (ii) there is no significant changes in the types or significant increase in the amounts of any effluents that may be released offsite; (iii) there is no significant increase in individual or cumulative public or occupational radiation exposure; (iv) there is no significant construction impact; (v) there is no significant increase in the potential for or consequences from radiological accidents; and (vi) the requirements from which an exemption is sought involve scheduling requirements. Therefore, in accordance with 10 CFR 51.22(b), no environmental assessment or environmental impact statement needs to be prepared in connection with the proposed exemption request.
If the requested exemption is approved by the NRC, certain offsite functions scheduled for the Byron Station 2013 biennial exercise would not have been conducted as originally scheduled on November 20, 2013. Whether or not these functions were conducted on this date would not have an effect on the environment since any outdoor activity during an exercise is limited to minimal use of roads and highways. The proposed action would not significantly increase the probability or consequences of an accident, change the types or quantities of radiological

ATTACHMENT 1 Request for Exemption Related to 10 CFR 50, Appendix E,Section IV.F.2.c Page 11 of 11 effluents that may be released offsite, or result in a significant increase in public or occupational radiation exposure since there would be no change to facility operations that could create a new accident or affect a previously analyzed accident or release path.
Since the proposed action would not have any adverse environmental effects, there are no alternatives necessary for reducing or avoiding adverse environmental effects. With regard to non-radiological impacts, no changes would be made to non-radiological plant effluents or activities that would adversely affect the environment. Therefore, no significant non-radiological impacts would be associated with the proposed action.
There are no federal permits, licenses, approvals or other entitlements which must be obtained in connection with the proposed action. The proposed action is not subject to any environmental quality standards or requirements imposed by federal, State, regional or local agencies having responsibility for environmental protection.

CONCLUSION As demonstrated above, EGC considers that this one-time exemption request from the requirements of Section IV.F.2.c of Appendix E to 10 CFR 50 to postpone specific functions of the biennial Emergency Preparedness exercise until February 2014, is in accordance with the criteria of 10 CFR 50.12. Specifically, this requested exemption is authorized by law, will not present an undue risk to the public health and safety and is consistent with the common defense and security. Also, special circumstances are present as set forth in 10 CFR 50.12(a)(2).

Illinois was severely impacted by a series of deadly tornados on November 17, 2013. The tornados caused multiple deaths and widespread damage throughout the state. State resources and personnel were immediately activated and deployed in support of the emergency response. Ultimately, this led to a Presidentially Declared Disaster for 15 Illinois counties.
Due to the magnitude of the State's disaster response, I made the decision on November 18th to request postponement of the Byron federally evaluated, biennial REP Exercise scheduled for November 20th
* Bill Conway made the initial notification of this decision to FEMA V's Ed Diaz that morning. Subsequently, Phil Anello confirmed the decision and received concurrence from Bill King regarding deferment during a later phone call. FEMA's understanding and flexibility in supporting Illinois' decision to postpone the exercise in light of the extreme devastation was greatly appreciated.
Dependent upon IEMA's schedule and availability, we would like to conduct the Byron Exercise at the earliest opportunity in 2014. We look forward to working with you and your staff in the coming weeks to determine a mutually suitable date.

This letter serves as follow-up to your staff s previous verbal notification that the State of Illinois had made the decision to postpone the conduct of the November 20, 2013 Byron Station Exercise due to the State's major involvement in the response to the devastating storms that affected a number of areas within the State. As mentioned at the time, we understood and agreed with your decision to postpone the exercise, and are now working with your staff to find a suitable make-up date for the Byron Station Exercise in the beginning of calendar year 2014, tentatively focused on the first week of February.
