Request for Amendment to Technical Specifications to Eliminate Requirements to Provide Monthly Operating Reports and Annual Occupational Radiation Exposure Reports In accordance with 10 CFR 50.90, "Application for amendment of license or construction permit," Exelon Generation Company, LLC (EGC) and AmerGen Energy Company, LLC (AmerGen) are requesting an amendment to Appendix A, Technical Specifications (TS) of the Facility Operating Licenses listed above. The proposed amendment will delete the TS requirements to submit monthly operating reports and annual occupational radiation exposure reports. The change is consistent with Revision 1 of NRC-approved Industry/Technical Specifications Task Force (TSTF) Standard Technical Specification Change Traveler, TSTF-369, "Removal of Monthly Operating Report and Occupational Radiation Exposure Report ."
The availability of this TS improvement was announced in the Federal Register (69 FR 35067) on June 23, 2004, as part of the Consolidated Line Item Improvement Process (CLIIP) .
The attached amendment request is subdivided as shown below.
Attachment 1 provides a description of the proposed changes and confirmation of applicability .
Attachments 2A - 2K include the marked-up TS pages for the stations listed above .
Attachments 3A - 3K include the associated typed TS pages with the proposed changes incorporated for the stations listed above .
Attachments 4A - 4J include the regulatory commitments for the stations listed above . Zion Nuclear Power Station does not have any associated regulatory commitments.
EGC and AmerGen request approval of the proposed change by April 29, 2005, with the amendment being implemented within 60 days of issuance .
The proposed amendment has been approved by the Plant Operations Review Committees at each of the stations and reviewed by the Chairman of the Nuclear Safety Review Board in accordance with the requirements of the EGC and AmerGen Quality Assurance Programs .
EGC and AmerGen are notifying the States of Illinois and New Jersey and the Commonwealth of Pennsylvania of this application for a change to the TS by sending a copy of this letter and its

As addressed in the safety evaluation published in the Notice of Availability for TSTF-369, EGC and AmerGen are proposing to adopt a part of NRC-approved Revision 4 to TSTF-258,

"Changes to Section 5.0, Administrative Controls." Specifically, the TS include a requirement to include in the monthly operating reports any challenges to pressurizer power operated relief valves or pressurizer safety valves (for pressurized water reactors) or safety/relief valves (for boiling water reactors) . The NRC model safety evaluation addressed the removal of requirements to submit monthly operating reports in those cases where the TS include a requirement to address challenges to relief and safety valves (i.e., if a licensee had not yet adopted the associated pat of TST4258) . The proposed change is consistent with the option described in the Notice of Availability published on June 23, 2004 (69 FR 35067) and the related documentation for both TSTF-369 and the limited portion of TSTF-258 included in this application . Removal of this requirement to address challenges to relief and safety valves is applicable to Braidwood, Byron, Clinton, Dresden, LaSalle, Limerick and Quad Cities .
As addressed in the safety evaluation published in the Notice of Availability for TSTF-369, the removal of the Monthly Operating Report and Annual Occupational Radiation Exposure Report TS Sections resulted in various editorial and formatting changes and do not revise technical or administrative requirements .
This application involves for sites with both operating and shutdown reactors . As addressed in the Notice of Availability    TSTF4369, EGC and AmerGen have included in this application a regulatory commitment to support the NRC need to apportion radiation doses reported under 10 CFR Part 20 to the different categories of reactors at these sites.
Zion Nuclear Power Station, Units 1 and 2 are both permanently shutdown . Therefore, EGC is requesting only a deletion of the Occupational Radiation Exposure Report from the Zion Permanently Defueled Technical Specifications,

==3.0     BACKGROUND==

The background for this application is adequately addressed by the NRC Notice of Availability published on June 23, 2004 (69 FR 35067) and TSTF-369 .
4.0     REGULATORY REQUIREMENTS AND GUIDANCE The applicable regulatory requirements and guidance associated with this application are adequately addressed by the NRC Notice of Availability published on June 23, 2004 (69 FR 35067) and TSTF-369 .

==5.0     TECHNICAL ANALYSIS==

EGC and AmerGen have reviewed the       the safety evaluation (SE) published on June 23, 2004, (69 FR 35067), as part of       CLIIP Notice of Availability . This verification included a review of the NRC's SE, and the supporting information provided to support TSTF-369 . EGC and AmerGen have concluded that the justifications presented in the TSTF proposal and the safety evaluation prepared by the NRC are applicable to the Braidwood, Byron, Clinton, Dresden, LaSalle, Limerick, Oyster Creek, Peach Bottom, Three Mile Island (TMI) Unit 1, Quad Cities and Zion stations and justify this amendment for the incorporation of the changes to the applicable TS .
The Limerick, Oyster Creek, and TMI Unit 1 TS are in a custom format that does not coincide with the industry Standard Technical Specifications (STS). The Limerick Generating Station TS Index reference to the Monthly Operating Report will be deleted in addition to the applicable TS Sections. Limerick, Oyster Creek and TMI Unit 1 Monthly Operating Reports and Occupational Exposure Reports are located in Section 6.0 compared to Section 5.0 for STS.

The Three Mile Island Unit 1 TS include a requirement in Section 3 .24, "Reactor Vessel Water Level Indication," to provide the details of reactor vessel water level instrumentation system channel inoperability in the Monthly Operating Report . This requirement is being revised to require submittal of a special report to the NRC providing the details of the inoperability within 14 days of one channel being inoperable for greater than 30 days, or both channels being inoperable for greater than 7 days.
Zion Nuclear Power Station, Units 1 and 2 are both permanently shutdown . Therefore, the Occupational Radiation Exposure Report will be deleted from the Defueled Technical Specifications .
6 .0    REGULATORY ANALYSIS A description of these proposed changes and the relationship to applicable regulatory requirements and guidance was provided in the NRC Notice of Availability published on June 23, 2004 (69 FR 35067) and 'TSTF4369.
6 .1     Verification and Commitments As discussed in the model SE published in the Federal Register on June 23, 2004, (69 FR 35067) for this TS improvement, EGC and AmerGen are making the following regulatory commitments.
1 . EGC and AmerGen are making a regulatory commitment to provide to the NRC using an industry database the operating data (for each calendar month) that is described in Generic Letter 97-02 "Revised Contents of the Monthly Operating Report," by the last day of the month following the end of each calendar quarter.
The regulatory commitment will be based on use of an industry database (e.g.,
the industry's Consolidated Data Entry (CDE) program, currently being developed and maintained by the Institute of Nuclear Power Operations). This regulatory commitment will be implemented to prevent any gaps in the monthly operating statistics and shutdown experience provided to the NRC (i.e ., data for all months will be provided using one or both systems (monthly operating reports and CDE)).
Zion Nuclear Power Station is permanently shutdown and is not required to provide a monthly operating report .
: 2. Dresden and Peach Bottom have both operating and shutdown units. EGC is making a regulatory commitment to provide information to the NRC annually (e.g., with the annual submittal in accordance with 10 CFR 20 .2206) to support the apportionment of station radiation doses to differentiate between operating and shutdown units. The data will provide the summary distribution of annual whole body doses as presented in Appendix B of NUREG-0713, "Occupational Radiation Dose at Commercial Nuclear Power Reactors and Other Facilities," for each operating and shutdown unit.
Braidwood, Byron, Clinton, LaSalle, Limerick, Oyster Creek, Quad Cities and Zion do not have different reactor types or both operating and shutdown reactors .

7.0     NO SIGNIFICANT HAZARDS CONSIDERATION Exelon Generation Company, LLC (EGC) and AmerGen Energy Company, LLC (AmerGen) have reviewed the proposed no significant hazards consideration determination published on June 23, 2004 (69 FR 35067) as part of the CLIIP. EGC and AmerGen have concluded that the proposed determination presented in the notice is applicable to Braidwood, Byron, Clinton, Dresden, LaSalle, Limerick, Oyster Creek, Peach Bottom, TMI Unit 1, Quad Cities and Zion stations and the determination is hereby incorporated by reference to satisfy the requirements of 10 CF R 50.91 (a).
8.0     ENVIRONMENTAL EVALUATION EGC and AmerGen have reviewed the environmental evaluation included in the model SE published on June 23, 2004 (69 FR 35067) as part of the CLIIP . EGC and AmerGen have concluded that the NRC's findings presented in that evaluation are applicable to Braidwood, Byron, Clinton, Dresden, LaSalle, Limerick, Oyster Creek, Peach Bottom, TMI Unit 1, Quad Cities and Zion stations and the evaluation is hereby incorporated by reference for this application.
9.0     PRECEDENT This application is being made in accordance with the CLAP . EGC and AmerGen are not proposing variations or deviations from the TS changes described in TSTF-369, Revision 1 and the limited portion of TSTF-258, Revision 4, or the NRC's model SE published on June 23, 2004 (69 FR 35067).

Bases The Reactor Vessel Water Level Indication (Reference 1) provides indication of the trend in water inventory in the hot legs and reactor vessel during the approach to inadequate core cooling (ICC) .          In this manner additional information may be available to the operator to diagnose the approach of ICC and to assess the adequacy of responses taken to restore core cooling .
Each Reactor Vessel Water Level channel is comprised of a hot leg level indication and a reactor vessel level indication .
The system is required to be operable          (as defined previously) when the plant is critical .
The system is an information system to aid the operator during the approach to inadequate core cooling .         There is no regulatory limit for this system .
Inoperability of the system removes the availability of an information system . Other useful instrumentation for inadequate core cooling will be available . The Subcooling Margin Indication System is relied upon to determine subcooling margin when the reactor coolant pumps are operating or when natural circulation can be verified . When natural or forced circulation cannot be verified, the margin to saturation is determined by manual calculation, based on reactor coolant temperature (incore thermocouples) and pressure indications available in the control room and steam tables . 6 .9     REPORTIN G REQUIR EMENTS In addition to the applicable reporting requirements of Title 10, Code of Federal Regulations, the following identified reports shall be submitted to the Administrator of the NRC Region 1 Office unless otherwise noted .
6 .9 .1  Routine Reports A . Startup Report . A summary report of plant startup and power escalation testing shall be submitted following (1) receipt of an operating license, (2) amendment to the license involving a planned increase in power level, (3) installation of fuel that has a different design or has been manufactured by a different fuel supplier, and (4) modifications that may have signi-ficantly altered the nuclear, thermal, or hydraulic performance of the plant . The report shall address each of the tests identified in the UFSAR, Chapter 13 and shall in general include a description of the measured values of the operating conditions or characteristics obtained during the test program and a comparison of these values with design predictions and specifications . Any corrective actions that were required to obtain satisfactory operation shall also be described .
Any additional specific details required in license conditions based on other commitments shall be included in this report .
Startup reports shall be submitted within (1) 90 days following completion of the startup test program, (2) 90 days following resumption or commencement of commercial power operation, or (3) 9 months following initial criticality, whichever is earliest . If the Startup Report does not cover all three events (i .e ., initial criticality, completion of startup test program, and resumption or commencement of commercial power operation),
supplementary reports shall be submitted at least every three months until all three events have been completed .

3 .24 Reactor Vessel Water Level Indication Applicability Applies to the operability requirements for the Reactor Vessel Water Level Indication when the reactor is critical .
Objectives To assure operability of the Reactor Vessel Water Level instrumentation which may be useful in diagnosing situations which could represent or lead to inadequate core cooling .
Specification Two channels of the Reactor Vessel Water Level Instrumentation System shall be OPERABLE .
If one channel becomes INOPERABLE that channel shall be returned to OPERABLE within 30 days . If the channel is not restored within 30 days, within 14 days, submit a special report to the NRC providing the details of the inoperability, to include cause, action being taken and projected date for return to OPERABLE status .
With no channels OPERABLE, one channel shall be restored to OPERABLE status within 7 days . If at least one channel is not restored within 7 days, within 14 days, submit a special report to the NRC providing the details of the inoperability, to include cause, action being taken and projected date for return to OPERABLE status .
Bases The Reactor Vessel Water Level Indication (Reference 1) provides indication of the trend in water inventory in the hot legs and reactor vessel during the approach to inadequate core cooling (ICC) .      In this manner additional information may be available to the operator to diagnose the approach of ICC and to assess the adequacy of responses taken to restore core cooling .
Each Reactor Vessel Water Level channel is comprised of a hot leg level indication and a reactor vessel level indication .
The system is required to be operable      (as defined previously) when the plant is critical .
The system is an information system to aid the operator during the approach to inadequate core cooling . There is not regulatory limit for this system .
Inoperability of the system removes the availability of an information system . Other useful instrumentation for inadequate core cooling will be available . The Subcooling Margin Indication System is relied upon to determine subcooling margin when the reactor coolant pumps are operating or when natural circulation can be verified .      When natural or forced circulation cannot be verified, the margin to saturation is determined by manual calculation, based on reactor coolant temperature (moose thermocouples) and pressure indications available in the control room and steam tables . See Tech . Spec . 3 .5 .5 .

The report shall include a summary of the quantities of radioactive liquid and gaseous effluents and solid waste released from the unit .
