This is in further response to your letter dated July 5, 1984, in which you requested,, pursuant to the Freedom of Information Act (F0IA), four categories of documer,ts concerning the Philippine nuclear power plant.
The enclosed Appendix A identifies documents which are being made available for your inspection and copying at th- NRC Public Document Room (PDR), 1717 H Street, NW, Washington, DC 20555. The documents will be filed in PDR folder F01A-84-559 under your name. Appendix B identifies documents which the NRC has already made publicly available at the PDR. The documents are filed in PDR folder F01A-78-243 under the name of Graeme W. Bush.
One additional six volume document, Section 2.5 of the PSAR of the Philippine nuclear power plant, has also been made publicly available at the PDR. It has    i been filed in PDR docket file number 55-74 The enclosed Appendix C identifies a document which contains infomation received in confidence from a foreign source. Under these conditions, the document is protected from mandatory public disclosure under the alternative test set out in National Parks and Conservation Association v. Morton, 498 F.
2d 765 (D.C. Cir. 1974). Under that test, a record can be withheld because disclosure would impair the Government's ability to obtain necessary infomation in the future. It is our view that a breach of understanding between the NRC and a foreign source could in the future inhibit the free flow of information to the NRC and could interfere with our mission. Therefore, the document is being withheld from public disclosure pursuant to Exemption 4 of the F0IA (5 U.S.C. 552(b)(4)) and 10 CFR 9.5(a)(4) of the Comission's regulations.
Pursuant to 10 CFR 9.9 of the NRC's regulations, it has been detemined that the infomation withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for the denial of the document are the undersigned and James R.
Shea, Director, Office of international Programs.

The Government Accountability Project is a non-profit, non partisan public interest organization concerned with honest and open government. Through legal representat ion, advice, national conferences, films, publications and public out reach, the Project promotes whistle blowers as agents of government accountability. GAP re-quests the above information as part of an on going monitorirg project on the ade-quacy of the governments efforts to protect the public safety and health at nuclear plants.
