SYNOPSIS This investigation was initiated on September 29, 1998, by the Nuclear Regulatory Commission (NRC), Office of Investigations (OI), Region IV (RIV), to determine if a Bechtel Construction, Inc. (BCI) contract painter, who worked at Southern California Edison's (SCE) San Onofre Nuclear Generating Station (SONGS), was the subject of employment discrimination by his supervisor for reporting concerns to the Nuclear Safety Concerns Program.
Based on the evidence developed, testimony, documents, and a review of the allegations by the technical staff and the regional counsel, the allegation that the contract painter was the subject of employment discrimination by his supervisor for reporting concerns to the Nuclear Safety Concerns Program was not substantiated.

Interview of Barry CLARK (Exhibit 14)
CLARK, Site Manager, BCI, was interviewed by OI:RIV on November 17, 1998, and advised he is the senior BCI representative at SONGS. CLARK explained the force ranking process and how it was utilized to evaluate BCI employees by assigning a numerical grade based on a sum total of points assigned to six categories: safety, quality, job knowledge, initiative, attendance, and productivity. The final number was used by management to determine who would be laid off during off peak times or when economic conditions warrant a reduction in force. He further explained that the foreman were briefed on what they should consider in the ranking process and then were placed in a conference room along with the general foremen and superintendent until the ranking process was completed.       He added that for each of the six categories, the following values are utilized:    four (4) - excellent, three (3) - above average, two (2) - average, and one (1) - below average.      CLARK cffered that the majority of journeymen painters should fall somewhere between a two or three. In a case where an individual had worked for different supervisora during the ranking period, CLARK advised that BCI encouraged the rater to talk with the other foremen who have supervised the individual. Upon completion of the initial stage of the ranking process by the foreman, the ranking was passed to the general foreman and then to the superintendent to ensure that uniformity and continuity had been applied to the process. Each of these individuals had the authority to change the ranking of any individual should they feel the individual was ranked inappropriately. In the case of the August 19, 1998, force ranking, Clark advised that MORIARITY and PARADA were the general foremen and Mike RODRIGUEZ and Bill TURNBOW were the superintendents. CLARK admitted that he did not look over the individual force rankings because he did not know the individual painters, but rather reviewed the process from a systematic perspective. He further explained that in a situation where a rated individual had an ssue or complaint with the force ranking process, the individual had the option of going through the union and requesting a review When queried as to whethar he [ CLARK) felt RICHARDSON was laid off as a result of retaliation, CLARK adamantly denied the NdT FOR PUBLIC DISCLOSURE _WITHOUT s     APPROVAL OF FIELD OFFICE DIRECTOR,-OFFICE OF INVESTIGATIONS;_ REGIO Case No. 4-1998-045 15

1 implication. CLARK explained that during the recent series of          l force rankings and subsequent lay offs, over 130 painters had          i been laid off. CLARK justified the terminations as a result of force ranking and not as a result of retaliation. CLARK admitted he did not have a " day-to-day hands-on knowledge" of the painters under his control and that he relied entirely upon his general foremen and superintendent for that type of information. In conclusion, CLARK advised that RICHARDSON had been rehired by BCI on November 16, 1998, as a carpenter.
Interview of David DeMARSICO (Exhibit 15)
DeMARSICO, Painter, BCI, was interviewed by OI:RIV on                  >

DeMARSICO stated he was not laid   off j as a result of the August 18, 1998, force ranking, explaining that he believed it was his positive attitude toward work that elevated him above his coworkers that had been laid off. of the other painters, to include RICHARDSON.      DeMARSICO denied    l having any knowledge that RICHARDSON's termination was as a            !
result of retaliation. He concluded by saying that he has never        i been instructed by anyone not to voice concerns to the                 l appropriate parties and that he w'ould feel comfortable in doing       l so.
Interview of Joseph COLEMAN (Exhibit 16)
COLEMAN, Painter, BCI, was interviewed by OI:RIV on November 17, 1998, and indicated he has been employed by BCI at SONGS since June 1992 and has served as a foreman on different occasions. In regard to the force ranking procedure, COLEMAN felt that more latitude should be given to the foreman in deciding who was to be selected for lay off. He opined that he was not a victim of the latest series of lay-offs because of his extensive experience in the painting field. He recalled that RICHARDSON had previously worked for him but that he [COLEMAN] did not have occasion to rank him. COLEMAN claimed he was unaware of any information indicating that RICHARDSON's lay off was a result of retaliation.
Interview of Garv ZUBER (Exhibit 17)
ZUBER was interviewed by OI:RIV on November 18, 1998, and advised he has been employed at various times by BCI at SONGS since 1977.
During his employment with BCI he has functioned as a journeyman painter and a for:eman. ZUBER stated he was familiar with the force ranking system having ranked numerous painters under his supervision in the past. He was aware that upon submitting his       ,
rankings to the general foreman, they (general foremen] had th>      I I
authority to change the ranking based on their evaluation. At lo time could he recall a general foreman advising him (ZUBER] that he (general foreman) had made a change. Additionally, he denied ever being advised by anyone to consult with another foreman during the force ranking process when an individual had worked for multiple supervisors during the ranking period. ZUBER opined that only the foremen and general foremen actually knew the painters they were ranking. He did not feel the superintendents or site manager had any personal insight into any of the painters,                                                            i l
ZUBER was specifically queried as to his knowledge of comments he    l allegedly heard made in a discussion involving Roland LaBEAF,        1 Supervisor, SCE; Chris CATES, Supervisor, SCE; and PARADA,           l wherein the phrase, "we got him, he'll be gone Monday" was conveyed. ZUBER explained that in August 1998, he was in the BCI
' office spaces filling out paperwork. The BCI office was geographically situated directly across from the office shared by LaBEAF and CATES. To the best of his knowledge, only LaBEAF and CATES were in the office. ZUBER admitted that while he did not actually see the individuals, he heard their voices and based on his familiarity with both LaBEAF and CATES, he [ZUBER) was certain it was LaBEAF who made the comment. ZUBER added that it sounded as if they were both ecstatic and had "high-fived" each other. ZUBER further elaborated that initially he did not know whom they (LaEEAF and CATES) were speaking of, but later thought, they (LaBEAF and CATES) were speaking about him {ZUBER]. the general foremen'about it, explaining that he trusts the         3 general' foreman., He added that within the force ranking           I procedure, 25 percent of the painters are placed in the top         ;
ranking, 50 percent in the middle, and 25 percent in the lower ranking. This guidance.was relayed to the foremen, prior to each
  . force ranking, in an effort to have the initial scores conform with the goals.

LTURNBOW was interviewed by OI:RIV on November 19, 1998, and         I advised he has been the maintenance superintendent, BCI, at SONGS since April-1998. TURNBOW explained the force ranking procedure and how he believed it was implemented without discrimination.
He further acknowledged that any changes made to the initial force ranking scores by the-general foremen were accepted by him in good faith because he trusted the general foremen and did not    !
possess an individual familiarity with the painters.      He was queried as to how he would prevent a general foreman from           I utilizing the force ranking process as a tool for retaliation.
TURNBOW admitted that without directly asking the general foreman why he may have changed a score, there would be no way to determine the general ~ foreman's motive. In regard to the
: August.19, 1998, force ranking, TURNBOW' admitted he did not make any. inquiries.of the changes made by the general foremen.
Interview of Terry HAYSE (Exhibit 21)
HAYSE was interviewed by OI:RIV on November 19, 1998, and advised he had been employed with BCI at SONGS since 1994 during which time he-has. served as a journeyman painter and foreman.      He

: 3. Adverse Action RICHARDSON's lay off was part of a general layoff of numerous other painters during a period of downsizing at SONGS. BROWN opined that "due to the large number of layoffs, it is not reasonable to infer from RICHARDSON's layoff alone, absent other information, that there was a I
connection between his protected activity and his subsequent layoff more than 4 months later as part of the last large group of painters to be laid off" (Exhibit 6). On November 16, 1998, RICHARDSON was rehired by BCI as a carpenter.
Conclusions                                                       l Based on the evidence developed, testimony, documents, and a review of the allegations by the technical staff and regional counsel, the allegation that RICHARDSON was the subject of employment discrimination by his supervisor for reporting concerns to the NSCP was not substantiated.
