In our {{letter dated|date=December 23, 1996|text=letter dated December 23,1996}}, Northeast Nuclear Energy Company (NNECO)                                         :
proposed that the independent, third party function to oversee the implementation of                                   .
NNECO's comprehensive plan, as required by the NRC's Order dated October 24,                                           1 1996, be fulfilled by a team under the direction of Mr. John W. Beck of Little Harbor Consultants, Inc. (LHC). The technical proposal from LHC was submitted with our letter dated Janwy 14,1997, and Revision 1 to the technical proposal was submitted with our {{letter dated|date=February 4, 1997|text=letter dated February 4,1997}}. Since then, LHC has replaced one member of the proposed team for the Independent Third Party Oversight Program (ITPOP), Mr.
Richard W. Dubiel, with Dr. John W. Poston, Sr. Attachment 1 to this letter contains a l
copy of Dr. Poston's resume and Independence Certification. The original of the Independence Certification is on file with LHC. Attachment 2 contains the revised ITPOP team structure and experience matrix.
Mr. Dublel, of Millennium Services, Inc., has withdrawn from the LHC team in order to allow Millennium Services, Inc. to be awarded a contrset to review radiological issues at the Haddam Neck Plant. We stated previously' that individual LHC team members and their companies will be contractually restricted from performing or seeking new work at                                ,
any NU facility for the duration of the ITPOP and for 12 months following completion of the ITPOP. We do not consider Mr. tubiel's withdrawal from the ITPOP team at tiiis                                     ,
time to conflict with this statement. Teos restriction will become effective after the LHC                             ;

       - B16318\Page 2 Mr. Dubiel's replacement, Dr. John W. Poston, Sr., has had a distinguished career in health physics and nuclear engineering. He is currently Professor and Head of the         !
Department of Nuclear Engineering at Texas A&M University. Dr. Poston also has            !
extensive industry experience which, combined with his academic background, make          i him an excellent addition to the LHC team. We evaluated Dr. Poston's independence         ,
using the same criteria established for the other LHC Team members, and we determined that he meets the independence requirement of the Order. Specifically, Dr.     ;
Poston has never been an employee of Northeast Utilities, and he has never had unescorted access to an NU nuclear facility. He is not an owner of record of NU stock.
We have also verified that Dr. Poston will be available to respond on a priority basis to any demand his involvement on the LHC team might require. He is av able at any time for an interview by you or a member of your staff.
To further ensure the independence of the proposed LHC team, NNECO reviewed our records to determine if any of the companies that the various members of the LHC team are associated with have employees that have been badged at Millstone Station. As a       ;
result of this review, additional information has come to our attention regarding prior involvement with NNECO of The Kestrel Group, Inc., the company owned by Mr. John M. Griffin. In previous correspondence and presentations, we indicated that an employee of Kestrel worked at Millstone Unit 1 during 1996 as the project manager for an assessment of the unit's work control process. Our review determined that there        ,
were two other individuals performing this assessment who were not employees of Kestrel but were under contract to the Kestre employee. The three individuals were involved in the project during tha months of August, September and October of 1996.
Our review did not determine any other inconsistencies with previous correspondence.
