Dear Mr. White:
Nuclear Waste Partnership (NWP) LLC, on behalf of the U. S. Department of Energy Carlsbad Field Office (DOE/CBFO), is submitting this request for an extension of 24 months to Condition No. 6 specified by the reference above for the exemption from Title 10, Code of Federal Regulations, Section 71.61 for the TRUPACT-III. Condition No. 6 identifies that the exemption expires on December 31, 2019.
Due to the initiation of two major capital asset projects at the Waste Isolation Pilot Plant (WIPP) located in southeastern New Mexico, the necessary facility preparations to safely and compliantly receive the two TRUPACT-III shipments from the Savannah River Site in South Carolina identified in the reference above may not be completed by December 31, 2019, consistent with Condition No. 6. DOE/CBFO continues to believe that the safe and compliant shipment of the two Standard Large Box 2 payload containers identified in the reference above is in the best interest of the environment and the public; however, it is equally important that completion and verification of the necessary facility preparations at the WIPP can be established. For this reason, NWP is requesting a 24-month extension of Condition No. 6 to December 31, 2021. No changes to the technical requirements previously submitted are requested and adherence to Condition Nos. 1 through 5 identified in the reference above, along with all other applicable conditions of Certificate of Compliance No. 9305, will be maintained.
