TheU.S.NuclearRegulatoryCommission(NRC)isissuingthisinformationnotice(IN)toprovidelessonslearnedandsummarizethedatasubmittedbylicenseestotheNRCintheir

fitness-for-duty(FFD)programperformancereportsforcalendaryears1998and1999.Itis

expectedthatrecipientswillreviewtheinformationforapplicabilitytotheirfacilitiesand

consideractions,asappropriate.However,suggestionscontainedinthisinformationnotice

arenotNRCrequirements,thereforenospecificactionsorwrittenresponseisrequired.DescriptionofCircumstancesSincethefitness-for-dutyrule(10CFRPart26)waspublished,licenseeshavesubmittedprogramperformancereportstotheNRC,asrequiredby10CFR26.71(d).Inthepast,the

NRCsummarizedandanalyzedthedatasubmittedbythelicenseesandpublishedanannual

volume,NUREG/CR-5758,"FitnessforDutyintheNuclearPowerIndustry-AnnualSummary

ofProgramPerformanceReports."In1998,theNRCissuedIN98-39toconveythis

informationfortheyears1996and1997.ThisINprovidessimilarinformationfor1998and

1999FFDstatisticsareprovidedinAttachment1.

DiscussionLessonslearned,managementinitiativesandproblems,andassociatedcorrectiveactionsreportedbylicenseesin1998and1999aresummarizedbelow.(1)CertifiedLaboratoriesSomelicenseescontinuetoexperienceproblemswithlaboratoryperformanceorhaveidentifiedpotentialweaknesses.Licenseesalsocontinuetoinvestigateandreviewadulterant

detectionstrategiestobeusedbylaboratories.ML010250419 IN2001-02Page2of7&#xff;Alicenseeassessornotedthatalaboratory'squalitycontrolblindsampleswerepotentiallyidentifiable.ThelaboratoryiscertifiedbytheU.SDepartmentofHealthand

HumanServices(HHS).Thelaboratorygivesthelicenseechain-of-custodyformswith

preprintednumbersandbarcodes.However,becausethelaboratory'sblindsamples

arenotprocessedwiththelicensee'schain-of-custodyforms,theblindsample

specimenchain-of-custodyformsareoutofsequencewiththerestofthesamplesin

thetray.Thelaboratorygenerateschain-of-custodyformsfortheblindsamples,using

thelaboratory'snextsequentialnumbers.Asaninterimcorrectiveaction,the

laboratoryisnowmixingsamplesfromdifferentsourcesinthetrayssothatthenon- sequentialchain-of-custodyformsfortheblindsampleswillbelessconspicuous.The

laboratoryistryingtodesignabettersolution.

&#xff;Onelicenseereviewedthepotentialimpactofingestionofhempseedoilproductsontetrahydrocannabinoltestresults,disseminateditsfindingstotheplantpersonnel,and

incorporatedthemintoFFDtraining.

&#xff;OnelicenseeusedIntoxilizer5000toverifythatover-the-countersubstancessuchasgum,Nyquil,Listerine,etc.,donotcausefalsepositivetestresults.

&#xff;OnelicenseelaboratoryreportedthatKlearisaneffectiveadulterantforthemarijuanametabolitebutiseasilydetectedifthespecimenistestedfornitrites.UrineLuckmade

bySpectrumLaboratoryismoredifficulttodetectbutisalsoalesseffectiveadulterant.

Twoblindspecimenswerespikedwithmarijuanametabolite.UrineLuckwas

introducedintooneofthespecimens.Onsiteimmunoassayscreeningfoundboth

specimenspositiveformarijuana.TheHHS-certifiedlaboratoryconfirmedboth

specimenspositive,althoughthequantitationlevelforthespecimencontainingUrine

Luckwasslightlylower(189ng/mlversus206ng/ml).Thelaboratorydidnotdetectthe

presenceofUrineLuck,nothavingdonetheadditionaladulteranttestingitwouldhave

doneifthescreeningandconfirmationtestingwerecontradictory.Thespecimens

wereretestedamonthlaterandfoundwithquantitationlevelsof163ng/mland

193ng/ml,respectively.ThelaboratorywilldomoreresearchtodetermineifUrine

Luckisaneffectiveadulterantforspecimenshavinglowerlevelsofthemarijuana

metaboliteandtodeterminewhetherMultistix10SGeffectivelydetectsthisadulterant.

&#xff;Otherlicenseesreportedtheyhadstartedtestingfortheadulterantsnitrate,pyridininiumchlorochromate,andglutaraldehyde.OnelaboratoryusesTestSure, manufacturedbySmithKline,totestforthefollowingconditionsandadulterants:pH,
specifygravity,bleach,creatinine,glutaraldehyde,nitrate,andpyridine.

&#xff;Inaccuratelaboratoryresultsforblindspecimenscontinuedtopointouthumanerrorproblems,particularlytheuseofincorrectcutofflevelsandproceduralweaknesses.

ThedifferentDepartmentofTransportationandNRCtestingrequirementscontributeto

theuseofincorrectcutofflevels,andlaboratoriesshouldbealerttodevelop

safeguardsagainstthiserror.Thecauseofinaccuraciesatonelaboratorywasthatthe

IN2001-02Page3of7laboratoryhadnoproceduretocontrolparameterchangesmadebytechnologistsonthescreeninginstrumentandtoverifyparametersettings.Thelaboratorycorrectedthe

problembyassigningpasswordsforthescreeninginstrument(sothatonlyapproved

personnelcouldchangetheinstrumentparameters)andbyrequiringanotherqualified

technologistorsupervisortocorroborateanychangesbeforetheinstrumentisused.In

addition,thelaboratoryimplementedaproceduretorequireaspecialqualitycontroltest

oftheinstrumentafterinstrumentparameterchanges,reagentchanges,andcalibration.

Theprocedureinvolvesspikingasampleataconcentrationapproximatelytwiceashigh

asthehighestcalibrator.

&#xff;Severallicenseesreportedthatreviewsofadulteranttestingshowedittobeusefulandcosteffective.

&#xff;Twolicenseesreportedthatthenumberofblindspecimenstheysubmittedtothelaboratorywasbelowtherequired10%foroneormorequartersof1999.Inonecase, thiswasduetomisunderstandingsbetweenthelicenseeandsiteFFD

programs-administrativeresponsibilitiesfortheseprogramsweresubsequently

separated.Noexplanationwasgivenforthesecondcase.

&#xff;Afterestablishinganonsitetestinglaboratory,onelicenseesuspendedunescortedaccessforpersonnelwhotestedpositiveforcocaineandmarijuana,pendingresults

fromtheHHS-certifiedlaboratory.Severallicenseesreportedworkingwithlaboratoriestoimprovetestingforspecificadulterants.Licenseescontinuedtoreportproblemswithlaboratoryperformance.

&#xff;Atonelaboratory,atechnicianscannedthebarcodeidentificationonthespecimenbottlelidratherthanonthesideofthebottle.Samplelidshadbeeninadvertently

switched,resultinginasampleidentificationerror.Thelaboratoryhaseliminatedretest

barcodesonbottlelidstoensurethattechniciansscanthesidesofspecimenbottles.

&#xff;Severallicenseesreportedthatlaboratoriesusedincorrectcutofflevelsorfailedtotestforthefulllistofsubstances.

&#xff;Onelicenseereportedtwoblindspecimensasnegativeforopiateswhentheyshouldhavebeenreportedpositive.Thecompanythatformulatedtheblindspecimenssaidthe

blindspecimenbatchesmightnothavebeenadequatelymixedbeforetheywere

prepared.Inaddition,thecompanywasnotperforminggaschromatography/mass

spectrometryoneachspecimen,onlyonthebatches.Thelicenseehascontractedwith

anewcompanytoprovideblindspecimens.(2)RandomTestingLicenseescontinuedtoreportincidentsinwhichemployeeswhoshouldhavebeenincludedintherandomtestingpoolwereomitted.

&#xff;Alicenseereportedthatithasreinstateda100%randomtestingrate.

IN2001-02Page4of7&#xff;Severallicenseesreportedthatworkershadbeenimproperlyexcludedfromthedrugtestingpoolforextendedperiods.Foronelicensee,anemployeewhoreturnedtothe

siteafteralengthystintattheInstituteofNuclearPowerOperations(INPO)wasnotput

backintotherandomFFDtestingpoolbecausehehadbeen"hardcoded"outofthe

system.Thislicenseeisreviewingtheprocessofhardcodingindividualsoutofthepool.

&#xff;Onelicenseereportedthatitenhanceditsquarterly"repetitivetask"processforverifyingtheintegrityoftherandomtestingpool.

&#xff;Licenseescontinuedtoimprovetheirnotificationprocessbyreducingtheintervalbetweennotifyingandtestingemployeesand/orbykeepingthemundercontinuous

observationduringthistime.

&#xff;Onelicenseeanalyzedthenumberofrandomscreeningsbydayofweekandtherateoffailuresforeachweekdayduring1998and1999.Thenumberofrandomscreenings

wasgreatestonMondayandgenerallyfelloneachsubsequentdayoftheweek.Very

fewscreeningsweredoneonSaturdayorSunday.In1998nopositiveresultswere

identifiedonSaturdaysorSundays.However,in1999thepositiverateonthesedays

wasveryhigh(Saturdaytestshada12.5%positiverateandSundaytestsa15%
positiverate).Theanalysissuggestspotentiallyusefulchangestothetestingschedule.Licenseescontinuedtoreportincidentsinwhichemployeeswhoshouldhavebeenincludedintherandomtestingpooldatabasewerenotincluded.

&#xff;Alicenseethatdidweeklyqualitycontrolchecksoftherandompooldiscoveredasoftwareprograminterfaceproblemasaresultofwhichcontractorswereomitted.One

weeklycheckshowed110contractorstohavebeenomitted.

&#xff;Anotherlicenseereportedthatanewcontractworkerhadnotbeenincludedintherandomtestpoolforthefirstdrawafterbeingbadgedandstartingwork.(3)PoliciesandProceduresSeverallicenseesreportedhavingimprovedtheirFFDpoliciesandproceduresonthebasisoftheirexperienceovertheyears.

&#xff;Anotherlicenseereduceditsmarijuanacutoffvaluefrom100ng/mlto50ng/ml.

&#xff;Onelicenseeintroducedalowercutoffvalueforalcoholtestingforindividualsinthefollowupprogramduetoapreviouspositivetestresultforalcohol.

&#xff;Onelicenseereduceditstestinglistofdrugsafterfindingthattherehadonlybeenasinglepositiveforbarbituratesandbenzodiazepinessinceitsprogramwasimplemented

in1990.

IN2001-02Page5of7&#xff;Onelicenseechangeditsspecimencollectionprocedurestoincludeanobservedcollectioniftheurinesamplefelloutsidetherangeof93-98degreesFahrenheitandan

oraltemperaturedidnotmatchtheurinetemperature.

&#xff;Somelicenseeshaveinstitutedazerotolerancepolicy,denyinganemployeeaccessafterafirstpositivedrugtestresult.

&#xff;Morelicenseesnowcountthedetectionofadulterantsasapositivetestresultandsanctionemployeesaccordingly.

&#xff;Alicenseepreparedthefollowingpolicystatementonprescriptionmarijuanaandcocaineandcommunicatedthestatementtoitsemployees:CertaindrugslistedintheControlledSubstanceActsuchasmarijuanaandcocainemaybelegallyprescribedandusedin

certainstates.However,federalregulationsdonotallow

involvementwithorpossessionoruseofthesedrugswithor

withoutaprescriptionbyindividualsassignedto[licenseename].

&#xff;SeverallicenseesfoundweaknessesintheirFFDrecordsmanagementprocedures.Intwocases,therecordsmanagementprocesswasadequatebutnotappropriately

documentedinprocedures.Inanothercase,FFDrecordsbeingpreparedforshipment

toanotherlocationforimagingwerenotstoredin1-hourfireratedcabinets,asrequired

inthesite-establishedprocedures.Inafourthcase,alicenseefoundthatthelogbook

maintainedbytheFFDprogramdidnotsatisfythedefinitionofapermanent,bound

recordbook.

&#xff;OnelicenseefoundthatitsproceduresfailedtospecifyFFDprogramtrainingrequiredforpersonnelassignedtoworkintheFFDprogram.

&#xff;ToenhanceoverallFFDatthesite,onelicenseenowrequiresemployeestoreportnon-job-relatedinjuriestoasupervisorormanagerbeforethestartofworkortraining

activitiesiftheinjurycouldimpairtheemployees'abilitytosafelyperformjob

assignments.Thesupervisorevaluatesinjuredemployees'fitnessandaccommodates

themasnecessary.

&#xff;Atonesite,acomputerdataentryerrorallowedacontractworkertoenteraprotectedareabeforetheworkerpassedapre-accesstest.AppropriateFFDpersonnelwere

trainedandtheaccessauthorizationprocessmodifiedtopreventthisfromhappening

again.&#xff;Onelicenseeintroducedlimitsonhowmuchtimeanemployeemaytaketogiveaurinespecimenandhowmuchwaterhemaydrinkbeforehand.

&#xff;Onelicenseespecifiedthatrequestsforretestingbemadewithin72hours.

&#xff;Onelicenseereportedthataneventatanotherlicensee'ssitehelpeditidentifyandaddressapotentialweaknessatitsownsite.TheeventinvolvedanFFDtesting

IN2001-02Page6of7technicianwhorecordeddrugscreentestresultsasnegativebeforetheywerevalidatedbythemedicalreviewofficer(MRO).Asaresult,accesswasgrantedtoafew

individualswhosetestresultswerelaterreportedtobepositive.Topreventthisfrom

happeningatitsownsite,thelicenseereviseditsproceduressothataccess

authorizationpersonnelcanonlyacceptreportsthathavebeenpreparedbytheMRO.

&#xff;OnelicenseeupdateditsFFDprocedurestoincludeapreciseformulabywhichtocalculatebloodalcoholconcentrationwhenanemployeearrivesatwork.

&#xff;Onelicenseediscoveredthatitspre-employmenttestingprotocolimpliedbreathalyzertestingirrespectiveofwhetherthecandidatehadyetbeenofferedajob,leavingthe

licenseevulnerabletobeingfoundinviolationoftheAmericansWithDisabilitiesAct.

&#xff;Onelicenseeinitiatedastandardizedchain-of-custodyformthroughoutitssites.(4)ProgramandSystemManagementLicenseescontinuedtoreportimprovementsinoverallFFDprogrammanagement.

&#xff;OnelicenseeplanedtomergeFFDwithAccessAuthorizationtoimprovecoordinationandeliminatethepotentialforerrors.ThislicenseeisalsotryingtorefineFFD

performanceindicators.

&#xff;Afewlicenseesreportedweaknessesintheirbehavioralobservationprogramsbecauseofinsufficienttraining.Othersreportedimprovementsintheirbehavioralobservation

programs.&#xff;FFDawarenessactivitiescontinuedtobereported(e.g.,sendingarticlesandnewsletterstoallemployees,givingtoallemployeesrefrigeratormagnetswiththetoll

freeemployeeassistanceprogramtelephonenumber).

&#xff;OnelicenseeencouragedsupervisorstocompleterefresherFFDtrainingontime.ThelicenseenowrigorouslymonitorsoverduesupervisorFFDtraining,sendsanaction

request,andsuspendsunescortedaccessforadelinquentsupervisorandforthe

workerswhoreporttothesupervisor.

&#xff;Atonesiteitwasdiscoveredthatsupervisorswhowerenotbadgedforunescortedaccessbutwhowererequiredtoreporttotheemergencyoperationsfacilitydidnothave

appropriateFFDtraining.CorrectiveactionswereimplementedtotrackFFDtraining

requirementsfornonbadgedsupervisors.

&#xff;Severallicenseesreportedthevalueofcaninesearchesinenhancingantidrugawarenessattheirsites,eventhesearchesthattypicallydidnotdiscoverdrugs.
