On May 15, 2023, the NRC issued the Staff Assessment of Updated Seismic Hazard Information and Latest Understanding of Seismic Hazards at the Vogtle Site Following the NRC Process for the Ongoing Assessment of Natural Hazards Information (ADAMS Accession No. ML23006A091 ). In this letter the NRC determined that "no further regulatory evaluation of the Vogtle Units 1 to 3, plant seismic risk is warranted at this time".

However, the letter then continues with a statement that may seem contradictory to the above language, and states that SNC "is responsible for considering the impact of this updated hazard on its plant-specific licensing basis including, approved risk informed applications, and, if applicable, the approved program for maintaining the plant-specific seismic probabilistic risk assessment supporting such applications," which could imply that future action is needed.

Other plants, such as North Anna and H.B. Robinson, were issued similar letters (ADAMS Accession Nos. ML23214A177 and ML23244A231 respectively) that did not include this potentially contradictory information. SNC requests that the NRC revise the letter to remove the quoted statement above from the May 15, 2023 letter to be consistent with letters issued to other utilities on this subject matter.
